This for the first time made provision for the adoption of measures of general scope designed to amend non-essential elements of a basic instrument.
It introduced the new procedure for measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the codecision procedure(Article 251 of the EC Treaty).
Most of the legal instruments concerned contain an explicit reference to Article 5a of the Council Decision of 17 July 200618, known as the Comitology Decision, which introduced the RPS and asserted the need to use this procedure for the adoption of measures of general scope designed to amend non-essential elements of a basic instrument.
This must be used for adopting measures of general scope which seek to amend(by deleting or supplementing)non-essential elements of a basic instrument adopted in accordance with Article 251 of the Treaty, i.e. under the codecision procedure.
The EESC considers that the modifications to Article 25 of the Regulation on claims, which describes the Committee procedure to be followed to adoptmeasures of general scope which amend non-essential elements of a basic instrument adopted using the codecision procedure, are essential.
The new Committee procedure has to be followed to adopt measures of general scope which seek to amend non-essential elements of a basic instrument adopted in accordance with the procedure referred to in Article 251 of the Treaty, inter alia by deleting some of those elements or by supplementing the instrument by the addition of new nonessential elements. .
The new'regulatory procedure with scrutiny' will relate to measures of a general scope which seek to amend non-essential elements of a basic instrument adopted in accordance with codecision.
It introduces a new regulatory procedure with scrutiny for measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the procedure referred to in Article 251 of the Treaty, including by deleting some of those elements or by supplementing the instrument by the addition of new non-essential elements. .
The directive codifies and adapts the legislation in force to the new comitology procedure with scrutiny[10]applying to measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the codecision procedure.
(3) It is necessary to follow the new regulatory procedure with scrutiny for measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the procedure referred to in Article 251 of the Treaty, including by deleting some of those elements or by supplementing the instrument by the addition of new non-essential elements. .
In the meantime Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission has been amended by Decision 2006/512/EC, which introduced a regulatory procedure with scrutiny for measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the procedure referred to in Article 251 of the Treaty.
Article 5a of the amended Decision introduces a new regulatory procedure with scrutiny for measures of a general scope which seek to amend non-essential elements of a basic instrument adopted in accordance with the co-decision procedure, inter alia by deleting some of those elements or by supplementing the instrument by the addition of new non-essential elements. .
This procedure is followed when adopting measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the procedure referred to in Article 251 EC, where necessary by deleting some of those elements or by supplementing the instrument by the addition of new non-essential elements(recital 3 in the preamble to Decision 2006/512 and Article 2(2) of the comitology decision).
