Act VI of 1998 on Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data.
The Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data was thus opened for signature by the member States of the Council of Europe in Strasbourg on 28 January 1981.

The Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data(CETS No. 108) opened for signature on 28 January 1981 and was the first legally binding international instrument in the data protection field.
Today we mark the 30th anniversary of theCouncil of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data(“Convention 108”).
The modernisation of the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, the only existing legally binding international treaty with global relevance in this field, addresses the challenges to privacy resulting from the use of new information and communication technologies, and strengthens the convention's mechanism to ensure its effective implementation.

Whereas the principles of the protection of the rights and freedoms of individuals, notably the right to privacy, which are contained in this Directive, give substance to and amplify those contained in the Council of Europe Convention of28 January 1981 for the Protection of Individuals with regard to Automatic Processing of Personal Data;
The Council of Europe's Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data(Convention 108) is open to accession by both European and non-European countries.
On May 18, 2018, the Council of Europe adopted a Protocol to amend theCouncil of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data.
The Republic of Serbiaaccepts the amendments to the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data(ETS 108) allowing the European Communities to accede to the Convention, as adopted by the Committee of Ministers in Strasbourg on 15 June 1999.
Mindful also of the right to the protection of personal data, as conferred, for example,by the 1981 Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data;….
The U.S. should accede to theCouncil of Europe's Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data(“Convention 108”), as it acceded to the 2001 Convention on Cybercrime.
(15) Its purpose is to secure in the territory of each contracting Party for every individual, whatever his nationality or residence, respect for his rights and fundamental freedoms,and in particular his right to privacy, with regard to automatic processing of personal data relating to him.
Since all Member States have ratified the Council of Europe Convention of28 January 1981 for the protection of individuals with regard to automatic processing of personal data, the personal data processed in the context of the implementation of this Framework Decision should be protected in accordance with the principles of the said Convention.
Personal data shall be stored and used pursuant to the obligationsundertaken by the Parties under the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data(ETS No. 108).
(14) Since all Member States have ratified the Council of Europe Convention of28 January 1981 for the protection of individuals with regard to automatic processing of personal data, the personal data processed in the context of the implementation of this Framework Decision should be protected in accordance with the principles of the said Convention.
Personal data regarding them shall be stored andused in conformity with the conditions provided for by the Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data(ETS No. 108).
It encourages the United States to accede to theCouncil of Europe's Convention for the protection of individuals with regard to Automatic Processing of Personal Data(Convention 108), as it has acceded to the 2001 Convention on Cybercrime, thus strengthening the shared legal basis for transatlantic relations in this field.
It must, Especially, take account of the accession of the third country in the Council of Europe Convention of28 January 1981 on the protection of individuals with regard to automatic processing of personal data and its Additional Protocol.
These rules will build upon the minimum data protection principles set by the Convention of28 January 1981 for the protection of individuals with regard to automatic processing of personal data and its Additional Protocol of 8 November 2001, and take account of Recommendation(87)15 regulating the use of personal data in the police sector, both adopted in the framework of the Council of Europe.
According to its recital 11, the'principles of the protection of the rights and freedoms of individuals, notably the right to privacy, which are contained in this Directive, give substance to and amplify those contained in the Council of Europe Convention of28 January 1981 for the protection of individuals with regard to automatic processing of personal data'.
On the“anniversary of the opening for signature of the Council ofEurope's Convention 108 for the Protection of Individuals with regard to automatic processing of personal data which has been for over 30 years a cornerstone of data protection, in Europe and beyond.”.
The 11th recital in the preamble to the Directive states that‘the principles of the protection of the rights and freedoms of individuals, notably the right to privacy, which are contained in this Directive, give substance to and amplify those contained in the Council of Europe Convention of28 January 1981 for the Protection of Individuals with regard to Automatic Processing of Personal Data'.
Promoting privacy standards internationally: The U.S. should accede to theCouncil of Europe's Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data(“Convention 108”), as it acceded to the 2001 Convention on Cybercrime.
On a broader front, the Union must be a driving force behind the development and promotion of international standards for personal data protection, based on relevant Union instruments on data protection andthe 1981 Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, and in the conclusion of appropriate bilateral or multilateral instruments.
