Annex I to Implementing Decision(EU) 2015/789 is amended as follows.
These changes need to be reflected in the Annex to Implementing Decision 2014/709/EU.
Annex I to Implementing Decision 2012/270/EU is amended as follows.
They did not, however, cover all the data now reported according to Implementing Decision 2011/850/EC.
The Annex to Implementing Decision 2014/709/EU was last amended by Commission Implementing Decision(EU) 2019/1392(5), following instances of African swine fever in Bulgaria.

From the date of deployment of the Automated Export System(AES)referred to in the Annex to Implementing Decision(EU) 2016/578 at the latest, paragraph 7 shall not apply in cases where non-Union goods are re-exported.
This article shall not apply until the respective dates of deployment of the AES, NCTS andthe upgrading of the national import systems referred to in the Annex to Implementing Decision 2014/255/EU are operational.
From the date of deployment of the Automated Export System(AES)referred to in the Annex to Implementing Decision(EU) 2016/578 at the latest, paragraphs 6 and 7 shall not apply in cases where Union goods falling within a category listed in Article 1(1) of Directive 2008/118/EC are exported.
The first customs office of exit and the subsequent customs office(s) of exit shall exchange that information in agreement with each other,and outside the Automated Export System referred to in the Annex to Implementing Decision(EU) 2016/578.

Since the date of adoption of Implementing Decision(EU) 2019/950, there have been further instances of African swine fever in domestic pigs in Lithuania that also need to be reflected in the Annex to Implementing Decision 2014/709/EU.
By derogation from paragraph 1 of this Article, until the date of the upgrading of thesystem referred to therein in accordance with the Annex to Implementing Decision 2014/255/EU, Member States shall use the New Computerised Transit System set up by Commission Regulation(EC) No 1192/2008(20).
In order to take account of recent developments in the epidemiological evolution of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new high-risk areas of a sufficient size should be demarcated for Latvia, Hungary, Slovakia, Romania and Poland and duly listed in Parts I,II and III of the Annex to Implementing Decision 2014/709/EU.
By derogation from paragraph 1, until the date of deployment of the upgrading of theNational Export Systems referred to in the Annex to Implementing Decision(EU) 2016/578, the list of data which may be required by the Commission for the purposes of surveillance at export is laid down in Annex 21-02.
By contrast, it refused the exemption of those rights on the ground that the conditions for benefiting from them were not fulfilled,since the undertaking invoice produced by the applicant contained a reference to Decision 2013/423 and not to Implementing Decision 2013/707 mentioned in the Export Undertaking Certificate.

Subject to the fulfilment of certain conditions, Article 3 of that regulation provides that imports invoiced by companies from which undertakings are accepted by the Commission andwhose names are listed in the annex to Implementing Decision 2013/707, including those exporting producers, are to be exempt from the anti-dumping duty imposed by Article 1 of the regulation at issue.
From the date of deployment of the Automated Export System(AES)referred to in the Annex to Implementing Decision(EU) 2016/578 at the latest, in the cases referred to in paragraphs 2 and 3, the customs office of exit shall inform the customs office of export that the goods were not taken out of the customs territory of the Union.
By derogation from the first paragraph of this Article, until the date of the upgrading of thesystem referred to therein in accordance with the Annex to Implementing Decision 2014/255/EU, Member States shall use the electronic system developed for the lodging and exchange of information relating to entry summary declarations in accordance with Regulation(EEC) No 2454/93.
Until the date of deployment of the UCC Proof ofUnion Status system referred to in the Annex to Implementing Decision 2014/255/EU, the customs authorities may authorise the manifest referred to in Article 199(2) serving to demonstrate the customs status of Union goods to be drawn up the day after the departure of the vessel, at the latest.
By derogation from paragraphs 5 and 6 of this Article, until the respective dates of deployment of the CCI andthe AES referred to in the Annex to Implementing Decision 2014/255/EU, the customs offices where the goods are presented may carry out further controls than those specified in the control plan on request of the supervising customs office or on their own initiative, with the results being reported to the supervising office.
Lack of capability to implement decisions.
The participating DGS shall take the necessary action to implement decisions referred to in this Regulation.
