Article 2 of the Convention requires States to take effective measures to prevent acts of torture.
The requirement to take effective measures to prevent acts of torture and other cruel, inhuman or degrading treatment or punishment, as stipulated in the Convention, is enshrined in Chapter II of the Constitution.
This provision introduces the obligation of the States parties to take effective measures to prevent acts of torture.
That means they have accepted obligations to take effective measures to prevent acts of torture and to ensure that any act of torture is an offence punishable under their criminal law.
The Special Rapporteur welcomes the recent entry into force of the Optional Protocol to the Convention against Torture andreminds States parties to the Convention of their obligation under its article 2 to take effective measures to prevent acts of torture in any territory under their jurisdiction.
Counsel also considers that the State party failed to take effective measures to prevent acts of torture in this case, in violation of article 2 of the Convention against Torture.

In accordance with article 2 of the Convention against Torture on taking effective measures to prevent acts of torture and in response to the concerns expressed by the Committee following the presentation of the third periodic report(CAT/C/CR/31/2), in particular the observation in paragraph 5(a), Moroccan law provides for a set of legal, judicial and administrative measures intended to prohibit torture on Moroccan territory.

As to the claim that his expulsion in addition would violate articles 2 and 16,the State party notes that article 2 requires a State party to take effective measures to prevent acts of torture, and that an expulsion cannot be considered an act which intentionally causes pain or suffering of such severity so as to bring it within the definition of torture contained in article 1, for one of the purposes enumerated there.
