Improvement of the status of women in the field of labour and employment.
In the field of labour and employment, the legal institution of protection from discrimination is regulated by the Labour Act Narodne novine, No. 137/04- consolidated text.
In relation to this, a package of new laws in the field of labour and employment legislation was prepared.
The Committee welcomes the newLabour Code of 2001, which introduces further protection against forced labour and discrimination in the field of labour and employment.
The main legislative act in the field of labour and employment is the Labour Code which was approved in 1973 based on labour legislation of the former Soviet Union.
Work has also been carried out under the programmes to improve Azerbaijani legislation in the field of labour and employment and to bring it into line with international norms.
With regard to the issue of discrimination in the field of labour and employment, article 37 of the Russian Constitution states that"Everyone shall have the right… to remuneration for work without any discrimination.
Since the submission of its second periodic report under the International Convention on the Elimination of All Forms of Racial Discrimination,Azerbaijani legislation in the field of labour and employment has been substantially amended.
In the field of labour and employment of women there have been no relevant changes relative to the extraordinary report which would pertain to the adoption of legal or other measures, although the assessment given in the extraordinary report that women in Yugoslavia bear the brunt of the burden in this field and suffer the dramatic consequences of the crisis and sanctions still holds true.
Moreover, article 16 of the Labour Code forbids direct orindirect discrimination in the field of labour and employment in respect of race, nationality, sex, creed, political beliefs or social origin.
Since 1992, the Azerbaijani Republic has been a member of the International Labour Organization(ILO) and has ratified 55 ILO conventions,several of which contain legal provisions relating to women in the field of labour and employment.
One positive aspect was the cooperation between the Women's Affairs Bureau and the Ministry of Labour, since there were many cases of discrimination in the field of labour and employment and much could be done to improve the status of women.
The Republic of Azerbaijan has been a member of the International Labour Organization(ILO) since 1992 and has ratified 55 ILO Conventions,several of which contain legal standards relating to women in the field of labour and employment.
In Chapter 2 of the Law of RK"On state youth policy" assigned to key areas of implementation of youth policy in the Republic of Kazakhstan and guarantees in the field of labour and employment, assistance in solving housing problems, government support youth entrepreneurship.
Combating discrimination in the labour market is also part of the European EQUAL programme, an initiative of the European Social Fund for the period 2000-2008,the aim of which is to combat all forms of discrimination and inequality in the field of labour and employment.
The Declaration on Gender Equality of the Assembly of the AP of Vojvodina strives for the achievement of the policy of equal opportunities for women and men in all areas,especially in the field of labour and employment, political and public life, social and health care, education, information, culture and sports.
With the aim of implementation of the Law on Gender Equality, the Agency drafted,published, and distributed the Recommendations of the Working Group for the Implementation of the Law on Gender Equality in BiH in the Field of Labour and Employment.
Regarding article 4 of the Convention, paragraphs 54, 70, 134, 146 and 147 of the periodic report contained useful information on legislation designed to combat genocide, crimes of hatred, racist propaganda or the dissemination of racist ideology, discrimination against consumers, discrimination by public officials, and in particular the various offences of a racial nature targeted in Law No. 7,716 of 5 January 1989 especially discrimination in the field of labour and employment and refusal to provide services.
In Uzbekistan, no distinctions, restrictions or preferences, either in legislation or in administrative practice, exist in relations among people or groups of persons on the grounds of race, skin colour, sex, religion, political views or ethnic or social origin, which in fact abolish or diminish the existence, recognition orexercise of equal opportunities in the fields of labour and employment.
The Law on Records in the Fields of Labour and Employment prescribes that records on unemployed persons contain information on the persons seeking employment who are registered with the branch office of the Employment Office which is competent for the territory where such persons have place of residence.
The provision of article 16 of the Anti-Discrimination Law prohibits discrimination in the field of labour and/or infringement of equal opportunities for employment or enjoyment, on equal terms,of all rights in the field of labour, such as: the right to work, free choice of occupation, career promotion, professional development and vocational rehabilitation, equal pay for the work of equal value, fair and satisfactory working conditions, annual leave, education and entry into trade unions, as well as unemployment protection.
The Provincial Labour, Employment and Gender Equality Secretariat was established in 2002 as a department of the Executive Council of the AP Vojvodina; the main objective of the Secretariat is to monitor and improve the conditions in the field of labour, employment and gender equality in the territory of the AP Vojvodina.
The social and economic policy run in the country primarily focuses on the protection of labour rights of citizens of the Republic of Azerbaijan,implementation of effective activities in the field of labour, employment and social protection of population, improvement of labour legislation, and meeting financial, social, morale and other vital demands of workers.
Realisation of management of social and economic processes,development of a policy in the field of labour, employment and migration, social securityand coordination of the activity of Akim's apparatus of settlements, timely information for analysis and preparation of decisions and orders of the Akim of the city, the formation of social economic environment;
The Procurator-General has ultimate responsibility for monitoring the consistent and uniform implementation of legislation in Azerbaijan, and the procurator's offices that report to him are ultimately responsible for monitoring protection of citizens' political, labour, individual and property rights and interests,including protection from any kind of discrimination in the field of labour, employment and choice of profession.
These goals are being pursued by improving legislation in the field of labour relations and employment policies; improving working arrangements; implementing measures aimed at promoting flexible forms of organisation of pre-school and pre-primary education and educational assistance to ensure child education, care and attendance and to create conditions for parents with family obligations to participate in the labour market; promoting corporate social responsibility and the development of family-friendly jobs.
From the statistics below we can see the real gender equality situation in some parts of the fields of labour, employment and access to all economic resources.
Over the past 20 years, Mr. Dai has been extensively involved in establishing and reforming China's human resources policies and has gained broad experience in the fields of labour, employment and human resources development.
This principle is further guaranteed by the Labour Code which in article 4(1) and article 33(1) stipulates that"citizens are free to associate in trade unions in order to express and defend their interests in the field of labour employment.
