The adopted second reading texts are presented in the form of draft articles.
The latter had taken the form of draft articles which might be used as the basis for a draft  convention.
The first reading text is provisionally presented in the form of draft articles.

The final text should, however,have taken the form of draft articles, not draft  principles.

His delegation supported the suggestions that work on the topic of  protection of  persons in the event of  disasters should proceed in the form of draft articles.
The Special Rapporteur would like to reiterate that although the proposals are presented in the form of draft articles of  a convention, this does not prejudge their final form.
He feels that the members of  the Commission, who are lawyers,might find it easier to react concretely if they are presented with proposals in the form of draft articles.
The instrument should take the form of draft articles, so that the allocation of  loss received the same treatment as the prevention of  transboundary harm, because the two regimes were closely bound up with each other.
One group of  States viewed it as imperative that these principles be expressed in the form of draft articles and in as prescriptive a form  as possible.

As in the case of  the work on prevention,the final version of  the draft  principles should take the form of draft articles, for that approach laid the foundations for a binding legal text.
Another view expressed was that so-called unilateral acts were so diverse, and so various and complex in nature,that they could not be codified in the form of draft articles.
It seemed necessary, as the Commission had suggested, to adopt guidelines andmodel clauses on reservations in the form of draft articles which would serve as a guide to States and international organizations on that matter.
In the light of  the foregoing, if the prevailing opinion of  States is against the adoption of a new universal convention, the Russian Federation would not object to a General Assembly resolution drawing attention to the end product of  the Commission in the form of draft articles.
He believed that,as the basic ideas that made up the topic were consolidated in a more consistent way in the form of draft articles, it would become easier to identify major areas in which there was consensus and to concentrate on the more controversial issues.
The Commission should analyse those events from which useful consideration could be drawn and which could, in turn,be presented in the form of draft articles or in some other form. .
As the topic is divided into the prevention and liability aspects andas one part was adopted in the form of draft articles, there is a justified expectation of  finalizing the other part on liability also in the form of draft articles.
Since the latter aspects had taken the form of draft articles on transboundary harm from hazardous activities and the elaboration of  a convention was recommended, a similar approach should have been followed with respect to the liability aspects and, in that connection, the elaboration of  a convention was favoured, noting that it was premature for the General Assembly to adopt a resolution as recommended by the Commission.
Should a final product of  the work of  the International Law Commission on the topic in question, whenever it is going to be elaborated,take the form of draft articles, rules, principles, guidelines or recommendations, or is it still too early to decide about it?
It may be recalled that the draft articles  on prevention were presented in the form of draft articles encased in some sort of  a framework convention on the lines of  the draft articles  on the law of  the non-navigational uses of  international watercourses adopted by the Commission in 1994.
He hoped, therefore, that, when the time came,the Commission would transmit the results of  its work on the topic of  expulsion of  aliens to the General Assembly in the form of draft articles, entrusting the Assembly with deciding what final form  they should ultimately take.
In accordance with the Commission's statute andits usual practice, this guide would take the form of draft articles whose provisions, together with commentaries, would be guidelines for the practice of  States and international organizations in respect of  reservations; these provisions would, if necessary, be accompanied by model clauses;
A provisional understanding was reached regarding the final outcome of  the work: while some States favoured non-binding guidelines,there was no objection to the suggestion that work should proceed in the form of draft articles, whose ultimate binding force could be decided at a later stage.
