Also protected within the constitutional framework are the right to life, freedom from arbitrary arrest or detention, freedom of movement,freedom from slavery and forced labour; freedom from inhuman treatment; freedom from deprivation of property; privacy of home and other property; provision to secure protection of law; freedom of conscience; freedom of expression and the press; freedom of assembly and association; and freedom from discrimination.
Subsequently, it is the Government of Saudi Arabia which has an obligation under domestic law andinternational human rights law to guarantee Mr. Shaqibel freedom from arbitrary arrest and detention and the right to a fair trial,from the time of his arrest in Saudi Arabia on 15 November 2009 to date.
At its 104th session, and with the assistance of a paper prepared by the Secretariat, in which criteria for the choice of general comments is established, the Committee decided to commence drafting a general comment on article 9(right to liberty andsecurity of the person and freedom from arbitrary arrest or detention) of the Covenant.
Urges the Government of the Sudan to further its efforts for the promotion and protection of human rights,in particular to ensure freedom from arbitrary arrest and detention, and to respect the human rights of all individuals, including human rights defenders and members of civil society organizations;
