In September and November 2007, the Prosecutor requested the referral of the cases of four accused detained at the Tribunal(Kanyarukiga, Hategekimana,Munyakazi and Gatete) to Rwanda.
The other requests for the referral of the Gatete and Kayishema cases are under consideration in the Trial Chambers, awaiting the decisions of the Appeals Chamber.
The cases of the four detainees have therefore been added to the trials workload to prosecute Munyakazi, Kanyarukiga,Hategekimana, and Gatete before the Trial Chambers of the Tribunal during 2009.
During the week of 12 to 18 June 2006, in the Gatete area of the commune of Rumonge(Bururi province), an unknown number of children are reported to have been recruited by FNL.
It is now expected that all trial activities, in terms of evidential hearings, will have concluded by the end of 2009 for all butfour cases Karemera et al., Gatete, Nzabonimana, and Ngirabatware.

It has also prepared and filed three appellant's or reply briefs(in Kanyarukiga, Setako and Munyakazi) and four respondent's briefs(in Ntawukulilyayao, Kanyarukiga, Nshogoza and Munyakazi) and is currently preparing two additional respondent's briefs(in Gatete and Hategekimana),as well as one appellant's brief in Gatete.
The postponement of the start of several of the new cases is due to a variety of factors, in particular,the resignation of defence counsels(Gatete and Kanyarukiga), which required additional time for preparation of new counsel, and the heavy workload of the judges sitting in several ongoing cases in parallel, so that the commencement of trials had to be also adjusted to their availability.
