To date, General Nkunda enjoys freedom of movement.

According to several CNDP insiders, Mr. Kamanzi has not been able to retain the loyalty of former CNDP military officers andbusinessmen who had backed General Nkunda and who had viewed Mr. Kamanzi's presidency as an imposition by Kigali.
With Rwanda backing General Nkunda and Colonel Mutebutsi's renegade soldiers, forces of the tenth military region reinvested in the superior military prowess of FDLR and new, circumstantial, alignments were formed.
In view of the reluctance of the Commander of the eighth military region, General Obedi, to oust General Nkunda from his stronghold, the Commander of the tenth military region was given the task instead.
When General Nkunda was arrested in Rwanda, many of his financial commissioners left the Democratic Republic of the Congo and thereby left General Ntaganda with no access to these international and regional financial support networks.
One of the principal issues of contention between General Ntaganda and General Nkunda following the latter's arrest in January 2009 in Rwanda was the control of the financial and accounting structures of CNDP.

Dissident General Nkunda, the chairman of CNDP, proposed peace talks, and the Government of the Democratic Republic of the Congo responded by organizing a broad-based peace conference in Goma, North Kivu, which began on 6 January 2008.
However, given the strong command and control within CNDP, andthe frequent visits by General Nkunda and General Taganda with the troops, the Group believes that both commanders are responsible for maintaining children within the ranks of CNDP;
The Group has also been informed by a number of sources in Rwanda andthe Democratic Republic of the Congo that following an initial period in which General Nkunda was isolated from outside contacts, he has held meetings with several of his former associates who have visited him in Kigali from May 2009 onwards.
The Group was informed by Kinshasa as well as Kivu military officials that an arrest warrant for both Colonel Mutebutsi and General Nkunda had been issued in the Democratic Republic of the Congo, but to date the Group is not aware of any official entreaties by the Democratic Republic of the Congo for the extradition of Colonel Mutebutsi.
In its first report, the Group demonstrated Rwandan support for military recruitment drives by Congolese military and political leaders,including the dissident General Nkunda, within refugee camps supported by the Office of the United Nations High Commissioner for Human Rights in Kiziba and Gihembe Rwanda.
During this period, intelligence anddiplomatic sources as well as CNDP insiders have informed the Group that General Nkunda has also held meetings with diaspora supporters who have, in turn, been in contact with FARDC officers loyal to General Nkunda, notably Colonel Makenga.
The situation remains extremely tense, with concerns over the intentions of the North Kivu Military Regional Commander, General Rwibasira Obedi,given his supposed ties with General Nkunda and the fact that he has twice failed to participate in consultations of all military regional commanders held in Kinshasa during the past month.
