The prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
The Committee has stressed the importance with which it views these obligations, as reflected, for example, in General Recommendation VII adopted in 1985 in which the Committee stressed themandatory character of article 4, and General Recommendation XV of 1993 in which the Committee stated its opinion that"the prohibition of the dissemination of all ideas based on racial superiority or hatred is compatible with the right to freedom of opinion and expression.

The Committee reiterates its view that the prohibition of the dissemination of ideas based upon racial superiority or hatred is compatible with freedom of opinion and expression and, in this respect, encourages the State party to examine the need to maintain its reservations to article 4(a) and(b) of the Convention with a view to reducing their scope and preferably their withdrawal.

Recalling its general recommendation No. 15(1993) on article 4 of the Convention, the Committee reminds the State party that the exercise of the right to freedom of opinion and expression carries special duties and responsibilities, andthat the prohibition of the dissemination of ideas based on racial superiority or racial hatred is compatible with the right to freedom of opinion and expression.
Notes that the Committee on the Elimination of Racial Discrimination holds that the prohibition of the dissemination of ideas based on racial superiority or racial hatred is compatible with the right to freedom of opinion and expression as outlined in article 19 of the Universal Declaration of Human Rights and in article 5 of the Convention;
With regard to the interpretation of article 4 of the Convention, the Special Rapporteur refers to Recommendation XV of the Committee on the Elimination of Racial Prejudice,in which the Committee expresses the opinion that"the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
In this regard the Committee recalls its general recommendations VII and XV,according to which the prohibition of dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression, given that a citizen's exercise of this right carries special duties and responsibilities, among which is the obligation not to disseminate racist ideas.
In addition, the former mandate holder noted that, in its general recommendation No. 15,the Committee on the Elimination of Racial Discrimination expressed the view that"the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
In its general recommendation XV(42),the Committee on the Elimination of Racial Discrimination expressed the opinion that the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion or expression, given the savings clause that the obligations of article 4 should be fulfilled with due regard to the principles embodied in article 19 of the Universal Declaration of Human Rights.
The Committee draws the attention of the State party to its general recommendations VII and XV, according to which article 4 is of mandatory nature, given the nonselfexecuting character of all its provisions, andthe prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the rights to freedom of opinion and expression.
In its general recommendation XV(1993),the Committee emphasized that the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression, as embodied in article 19 of the Universal Declaration.
Recalling general recommendation No. 15(1993) on article 4 of the International Convention on the Elimination of Racial Discrimination, the Committee reminds the State party that the exercise of the right to freedom of opinion and expression carries with it duties and responsibilities, andthat the prohibition of the dissemination of ideas based on racial superiority or racial hatred is compatible with the right to freedom of opinion and expression.
While noting the State party's concerns in regard to freedom of speech,the Committee recalls that the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression arts. 2 and 4 of the Convention.
The Committee also clearly stated that in its opinion,"the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
CERD was fully aware of the related problems andstressed in general recommendation No. 15 that"the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
On article 4 of the International Convention on the Elimination of All Forms of Racial Discrimination,holds that the prohibition of the dissemination of ideas based on racial superiority or racial hatred is compatible with the right to freedom of opinion and expression as outlined in article 19 of the Universal Declaration of Human RightsResolution 217 A III.
