During the unlawful occupation of Kuwait by Iraq, we kept contact with the concerned authorities in exile.
To be compensable, the loss must be demonstrated to have been“directly” caused by the invasion and occupation of Kuwait by Iraq.

There is considerable evidence(including photographic evidence)to indicate that the loss of motor vehicles during the invasion and occupation of Kuwait by Iraq was enormous.
The Committee acknowledges that, as a result of the invasion and occupation of Kuwait by Iraq, the State party was subjected to serious difficulties which continue to affect the capacity of the State party to fully implement all of the provisions in the Convention.
The Panel has taken into account the extensive evidence of large scale loss of motor vehicles during the invasion and occupation of Kuwait by Iraq, as described above.
The organization of the Allied Coalition Armed Forces began a few days after the occupation of Kuwait by Iraq, and continued with the placement of armed forces and air and naval military units from 28 countries, including Kuwait, in the Persian Gulf region.

The D7 real property claim is for US$214,576.12 that the Claimant states he spent on repairing andrefurbishing his residence which was damaged during the invasion and occupation of Kuwait by Iraq.
Political events and past wars have taken place that cannot be ignored that represented a flagrant challenge to our Organization-- starting with the Israelioccupation of Arab territories, the occupation of Kuwait by Iraq, the flouting by Saddam Hussain of United Nations resolutions over a period of 12 years, and the divided views of the international community on how to address those violations.
In other words, for the claim to be compensable the claimant must show that the payments were made orthe relief was provided under circumstances that are directly related to the invasion and occupation of Kuwait by Iraq.
The experiences of the Compensation Commission in handling claims for compensation for environmental damage resulting from the unlawful invasion and occupation of Kuwait by Iraq may, nevertheless, be of some value in terms of defining environmental damage in a case such as the present one, in measuring and quantifying the damage sustained and in determining the amount of compensation payable in respect of it.
To be compensable, the loss incurred due to the claimant's inability to leave or return ordecision not to return must be demonstrated to have been a“direct” result of the invasion and occupation of Kuwait by Iraq.
Welcoming the conclusion of the Secretary-General that the experience of the United Nations Compensation Commission in handling claims for compensation for environmental damage resulting from the unlawful invasion and occupation of Kuwait by Iraq may be of some value in terms of defining environmental damage in a case such as the present oil slick, in measuring and quantifying the damage sustained and in determining the amount of compensation payable in respect of it.
More recent cases include non-recognition of the annexation by Israel of the Golan Heights and the ensuing protests,direct opposition to the creation of a Turkish Cypriot State and the occupation of Kuwait by Iraq.
The Government asserts that the Funds Raised were required“for the direct support andrecovery of Kuwait and its people during and after the occupation of Kuwait by Iraq, including the reconstruction of Kuwait's civil infrastructure”.
Still, decision 1 provides, at paragraph 18, that losses caused by an inability to leave or return to Iraq or Kuwait or a decision not to return(“relocation costs”) are compensable if they resulted from circumstances that occurred during the jurisdictional period andthat were directly related to the invasion and occupation of Kuwait by Iraq.
Panellists reflected on lessons learned from various international and national reparation schemes,starting with the Security Council's role in establishing the United Nations Compensation Commission for the compensation of losses arising as a direct result of the invasion and occupation of Kuwait by Iraq, including many that were violations of international humanitarian law and human rights law.
For a claim to be compensable, a claimant must first demonstrate that he or she owned the property claimed and that the property was lost ordamaged as a direct result of the invasion and occupation of Kuwait by Iraq.
However, as stated in my previous report, the mandate of the Commission is limited to processing claims and paying compensation for losses anddamage suffered as a direct result of the unlawful invasion and occupation of Kuwait by Iraq.
With respect to the claim for the amount of USD 39,600,the Panel is satisfied that the testing of the installation which was to occur in October 1990 was prevented as a direct result of the invasion and occupation of Kuwait by Iraq on 2 August 1990.
The claimant did not submit proof of the efforts that he had made to gain access to his bank accounts in Iraq orof whether his inability to transfer his funds out of Iraq was the direct result of the invasion and occupation of Kuwait by Iraq.
In resolution 674(1990), the Security Council reminds Iraq'that under international law it is liable for any loss, damage or injury arising in regard to Kuwait and third States and their nationals and corporations,as a result of the invasion and illegal occupation of Kuwait by Iraq.
