Just and adequate reparation or satisfaction for any damage as a result of such discrimination.
With respect to article 6 of the Convention, concern is expressed over the lack of legislative provisions to implement the right to just andadequate reparation or satisfaction for any damage suffered as a result of acts of racial discrimination.
Under article 6 of the International Convention on the Elimination of All Forms of Racial Discrimination, States parties shall assure to everyone within their jurisdiction effective protection and remedies, through the competent national tribunals and other State institutions, against any acts of racial discrimination which violate human rights and fundamental freedoms contrary to the Convention, as well as the right to seek from the tribunals just andadequate reparation or satisfaction for any damage suffered as a result of such discrimination.
Information was also required on the right to seek just reparation or satisfaction for any damage suffered as a result of discrimination.
Recalling that article 6 of the Convention requires States parties to assure to everyone within their jurisdiction effective protection and remedies, through the competent national tribunals and other State institutions, against any acts of racial discrimination, as well as the right to seek from such tribunals just andadequate reparation or satisfaction for any damage suffered as a result of such discrimination.
In the light of article 6 of the Convention,the Committee notes that the only way of obtaining reparation or satisfaction for any damage suffered as a result of an act of racial discrimination is through a penal proceeding.
The Committee recommends that comprehensive information be provided on legislative and other measures adopted by the State party to comply with provisions of article 6 of the Convention and on the availability of the right to seek from the courts just andadequate reparation or satisfaction for any damage suffered as a result of racial discrimination.
Measures guaranteeing the right to seek from these tribunals just andadequate reparation or satisfaction for any damage suffered as a result of such discrimination.

He drew attention in that connection to article 6 of the Convention concerning the entitlement to just andadequate reparation or satisfaction for any damage suffered as a result of racial discrimination.
When assessing his liability for damages, the District Court explicitly referred to article 6 of the International Convention on the Elimination of All Forms of Racial Discrimination, under which victims of discrimination have the right to seek just andadequate reparation or satisfaction for any damage suffered as a result of discrimination.

The Committee reaffirms that the provisions of article 6 of the Convention are mandatory and that the Government of India should adopt legal provisions making it easier for individuals to seek from the courts just andadequate reparation or satisfaction for any damage suffered as a result of acts of racial discrimination, including acts of discrimination based on belonging to a caste or a tribe.
The Committee urges the State party to take effective measures, as provided for in article 6 of the Convention, to ensure that everyone within its jurisdiction enjoys effective protection and remedies through the competent national courts and other State institutions against any acts of racial discrimination which violate his or her rights, as well as the right to seek from such courts just andadequate reparation or satisfaction for any damage suffered as a result of such discrimination, including restitution.

Article 6 requires States parties to assure persons within their jurisdictions effective protection and remedies through tribunals and other institutions for acts of racial discrimination, including the right to seek"just andadequate reparation or satisfaction for any damage suffered as a result of such discrimination.
Ensuring that people of African descent have full access to effective protection and remedies through the competent national tribunals and other State institutions against any acts of racial discrimination, and the right to seek from such tribunals just andadequate reparation or satisfaction for any damage suffered as a result of such discrimination;
The Committee also urges the State party to ensure that everyone within its jurisdiction enjoys the right to effective protection and remedies against discrimination in all areas of public and private life, including in accessing housing and the labour market, and in treatment at work and at school,with adequate reparation or satisfaction for any damage suffered as a result of such discrimination, in accordance with article 6 of the Convention.
