Setako is charged with genocide, or in the alternative complicity in genocide, crimes against humanity and serious violations of Article 3 common to the Geneva Conventions and Additional Protocol II of 1977.
The evidence phase in two other single-accused cases,Kalimanzira and Setako, will also run into the first half of 2009, due to particular circumstances explained above.
In addition, Trial Chamber I continued pre-trial work in relation to five cases, which included pre-trial hearings in all cases Jean-Baptiste Gatete, Callixte Kalimanzira, Gaspard Kanyarukiga,Yusuf Munyakazi and Ephrem Setako.
Due in particular to staffing constraints, it is now, however,likely that the work on his last case, Setako, in which he is the Presiding Judge, will not be completed before early 2010.
It has also prepared andfiled three appellant's briefs(in Nsengimana, Setako and Munyakazi) and one respondent's brief(in Setako) and is preparing two additional respondent's briefs in Munyakazi and Ntawulkulilyayo.
It is anticipated that the hearing of evidence in one ongoing multi-accused case involving three accused persons(the Karemera case) andfive single-accused cases(Kalimanzira, Setako, Bagaragaza, Nshogoza and Muvunyi retrial) will extend into 2009.
However, work continues in the following remaining six cases involving 19 accused: Setako, Karemera et al.(3 accused), Nyiramasuhuko et al.(6 accused), Ndindiliyimana et al.(4 accused), Bizimungu et al.(4 accused), and Nsengimana.

Théoneste Bagosora, Aloys Ntabakuze and Anatole Nsengiumva,as well as Tharcisse Muvunyi and Ephrem Setako filed appeals against their respective trial judgements, as did the prosecutor in the Muvunyi and Setako cases.
