On this understanding, the Special Commission and the Director General of IAEA have prepared, for consideration and approval by the Sanctions Committee, a proposal for a mechanism for export/import monitoring under paragraph 7 of Security Council resolution 715 1991.
Consequently, this preambular paragraph in A/48/L.13 as it stands now contradicts the reports of the president of the Special Commission and the Director General of the IAEA, and cannot be considered as it is correct.
Requests the Committee established under resolution 661(1990), the Special Commission and the Director General of the International Atomic Energy Agency to develop in cooperation a mechanism for monitoring any future sales or supplies by other countries to Iraq of items relevant to the implementation of section C of resolution 687(1991) and other relevant resolutions, including the present resolution and the plans approved hereunder;
Demands that Iraq meet unconditionally all its obligations under the plans approved by the present resolution and cooperate fully with the Special Commission and the Director General of the International Atomic Energy Agency in carrying out the plans;
I am transmitting herewith, with the concurrence of the Executive Chairman of the Special Commission and the Director General of the International Atomic Energy Agency(IAEA),a report prepared by the Committee established by Security Council resolution 661(1990), the Special Commission and the Director General of IAEA that contains the provisions for the mechanism for export/import monitoring under paragraph 7 of Security Council resolution 715(1991) of 11 October 1991.
With reference to the letters dated 12 August 1998 from the Executive Chairman of the Special Commission and the Director General of the International Atomic Energy Agency(IAEA) addressed to the President of the Security Council, I should like to communicate the following facts.
Requests the Secretary-General to report to the Council as soon as possible with regard to the finalization of procedures for Presidential sites in consultation with the Executive Chairman of the United Nations Special Commission and the Director General of the International Atomic Energy Agency(IAEA);
Decides that all States shall, not later than 45 days after the adoption of this resolution, be provided by the Special Commission and the Director General of the IAEA with information necessary to make preparatory arrangements at the national level prior to the implementation of the provisions of the mechanism;
Of 2 March 1998 the Memorandum of Understanding signed by the Deputy Prime Minister of Iraq and the Secretary-General on 23 February 1998(S/1998/166); and requested the Secretary-General to report to the Council as soon as possible with regard to the finalization of procedures for presidential sites in consultation with the Executive Chairman of the Special Commission and the Director General of the International Atomic Energy Agency IAEA.
Calls upon all States and international organizations to cooperate fully with the Committee established under resolution 661(1990), the Special Commission and the Director General of the IAEA in the fulfilment of their tasks in connection with the mechanism, including supplying such information as may be sought by them in implementation of the mechanism;
By resolution 1154(1998), the Security Council, acting under Chapter VII of the Charter, inter alia, endorsed the memorandum of understanding signed by the Deputy Prime Minister of Iraq and the Secretary-General on 23 February 1998(S/1998/166); and requested the Secretary-General to report to the Council as soon as possible with regard to the finalization of procedures for presidential sites in consultation with the Executive Chairman of the Special Commission and the Director General of IAEA. Decides to encourage the maximum assistance, in cash and in kind,from all Member States to support the Special Commission and the Director General of the International Atomic Energy Agency in carrying out their activities under the plans approved by the present resolution, without prejudice to Iraq's liability for the full costs of such activities;
Decides that the notifications required under paragraph 5 above shall be provided to the joint unit by Iraq, in respect of all items and technologies referred to in paragraph 12 of the mechanism,as from the date agreed upon between the Special Commission and the Director General of the IAEA and Iraq,and in any event not later than sixty days after the adoption of this resolution;
Noting the letters of 18 August 1998 from the President of the Security Council to the Executive Chairman of the Special Commission and the Director General of the IAEA(S/1998/769, S/1998/768), which expressed the full support of the Security Council for those organizations in the implementation of the full range of their mandated activities, including inspections.
Letter dated 7 December(S/1995/1017) from the Chairman of the Security Council Committee established by resolution 661(1990) concerning the situation between Iraq and Kuwait addressed to the President of the Security Council,transmitting a report prepared by the Committee, the Special Commission and the Director General of IAEA, containing the provisions for the mechanism for export/import monitoring under paragraph 7 of Council resolution 715 1991.
In its paragraph 7,the Council requested the Committee established under resolution 661(1990), the Special Commission and the Director General of the International Atomic Energy Agency(IAEA) to jointly develop a mechanism for monitoring any future sales or supplies by other countries to Iraq of items which could be used for the production or acquisition of banned weapons.
Demands that Iraq meet unconditionally all its obligations under the mechanism approved by this resolution and cooperate fully with the Special Commission and the Director General of the IAEA in the carrying out of their tasks under this resolution and the mechanism by such means as they may determine in accordance with their mandates from the Council;
Transmit to the joint unit constituted by the Special Commission and the Director General of the IAEA under paragraph 16 of the mechanism the notifications, with the data from potential exporters,and all other relevant information when available to the States, as requested in the mechanism on the intended sale or supply from their territories of any items or technologies which are subject to such notification in accordance with paragraphs 9, 11, 13, 24, 25, 27 and 28 of the mechanism;

Recalling the request in paragraph 7 of its resolution 715(1991)to the Committee established under resolution 661(1990), the Special Commission and the Director General of the International Atomic Energy Agency(IAEA) to develop in cooperation a mechanism for monitoring any future sales or supplies by other countries to Iraq of items relevant to the implementation of section C of resolution 687(1991) and other relevant resolutions, including resolution 715(1991) and the plans approved thereunder.
Requests the Security Council Committee established under resolution 661(1990)concerning the situation between Iraq and Kuwait, the Special Commission and the Director General of the[International Atomic Energy] Agency to develop in cooperation a mechanism for monitoring any future sales or supplies by other countries to Iraq of items relevant to the implementation of section C of resolution 687(1991) and other relevant resolutions, including the present resolution and the plans approved hereunder;
However, its formal transmission to the Security Council, as the tripartite proposal by the Sanctions Committee, the Special Commission and the Director General of IAEA called for under paragraph 7 of resolution 715(1991), was postponed pending indications of the concurrence of their Governments from all members of the Committee. On 6 December 1995, the Sanctions Committee, having obtained such concurrence, authorized its Chairman to address a letter to the President of the Security Council, transmitting the mechanism for approval by the Council.
At the informal consultations of the whole held on 13 October 1998,the members of the Council took up the sixth consolidated progress reports of the Executive Chairman of the Special Commission(S/1998/920) and the Director General of IAEA(S/1998/927) pursuant to resolution 1051 1996.
