II. Review of two applications for approval of plans of work for exploration by Nauru Ocean Resources Inc. and Tonga Offshore Minerals Ltd.
The application area of Tonga Offshore Mining Limited covers a total of 74,713 km2 in the Clarion-Clipperton Zone of the Pacific Ocean.
These applications were submitted by Nauru Ocean Resources Inc.(sponsored by Nauru) and Tonga Offshore Mining Ltd. sponsored by Tonga. .
These applications were made by Nauru Ocean Resources Inc.(NORI), Tonga Offshore Minerals Ltd.(TOML), China Ocean Research and Development Association(COMRA) and the Russian Federation.
Decision of the Council relating to a request for approval of a plan of work for exploration for polymetallic nodules submitted by Tonga Offshore Mining Limited.
The applications submitted byNauru Ocean Resources Inc.(NORI), sponsored by Nauru, and by Tonga Offshore Mining Ltd.(TOML), sponsored by Tonga, related to exploration for polymetallic nodules.
Accordingly, pursuant to regulation 21, paragraph 5, of the Regulations,the Commission recommends to the Council approval of the plan of work for exploration submitted by Tonga Offshore Mining Limited.
These applications were made by Nauru Ocean Resources Inc.(NORI), Tonga Offshore Minerals Ltd.(TOML), China Ocean Mineral Resources Research and Development Association(COMRA) and the Russian Federation.
The application was submitted pursuant to the Regulations on Prospecting and Exploration for Polymetallic Nodules in the Area(ISBA/6/A/18,annex) by Tonga Offshore Mining Limited TOML.
As at May 2014, DORD,G-TEC Sea Mineral Resources NV, Tonga Offshore Mining Limited(TOML) and BGR had agreed in writing to amend their contracts to include the new standard clauses.
In 2011, the Council approved plans of work for exploration for polymetallic nodules by Nauru Ocean Resources Inc.(NORI)(Nauru) and Tonga Offshore Mining Ltd.(TOML) Tonga. .

This is evidenced by the request by Nauru Ocean Resources Inc. and Tonga Offshore Mining Ltd. to reinstate their applications for plans of work before the Legal and Technical Commission as well as by the number of enquiries by other entities and groups of entities that have been made about possible applications for plans of work for exploration in the Area.
These applications were submitted by Nauru Ocean Resources,Inc.(sponsored by the Republic of Nauru) and Tonga Offshore Mining Ltd. sponsored by the Kingdom of Tonga. .
On 5 May 2009, the Secretariat was informed by Nauru Ocean Resources Inc. and Tonga Offshore Mining Ltd.(the applicant companies) that, in the light of current global economic circumstances and other concerns, they had decided to request that consideration of their applications for approval of plans of work for exploration for polymetallic nodules be postponed ISBA/15/LTC/6.
The Council approved applications by Nauru Ocean Resources Inc.,sponsored by the Republic of Nauru, and by Tonga Offshore Mining Ltd., sponsored by the Kingdom of Tonga. .
In its application for approval of a plan of work for exploration for polymetallic nodules in the Area, Tonga Offshore Mining Limited(TOML) informed the Authority that it was sponsored by the Kingdom of Tonga, and in the certificate of sponsorship issued by the Government of Tonga, the Government declared further that it assumed responsibility in accordance with article 139, article 153, paragraph 4, and annex III, article 4, paragraph 4, of the Convention.
Requests the Secretary-General of the Authority to issue the plan of work for exploration for polymetallic nodules in the form of a contract between the Authority and Tonga Offshore Mining Limited in accordance with the Regulations.
The Committee noted that, of the 16 relevant contracts, Deep Ocean Resources Development Ltd., the Federal Institute for Geosciences andNatural Resources of the Federal Republic of Germany, Tonga Offshore Mining Limited, G-TEC Sea Mineral Resources N.V. had agreed to amend their contracts and to pay the overhead charges; UK Seabed Resources Ltd. had paid the overhead charge for 2014, but the contract was yet to be amended in accordance with decision ISBA/19/A/12.
In accordance with regulation 12, paragraph 5(b) of the Regulations, the Commission was also provided with the financial statementsof Nautilus Minerals Incorporated, the parent company of Tonga Offshore Mining Limited, for 2007 to 2010.
The Commission was informed that a total of eight training places had been made available in 2013 by the China OceanMineral Resources Research and Development Association(COMRA), Tonga Offshore Mining Limited(TOML) and the Federal Institute for Geosciences and Natural Resources of the Federal Republic of Germany(BGR), pursuant to their contracts for exploration with the Authority.
