Скайкоп і Клієнт можуть окремо домовитися про інший розмір винагороди.By entering into an Agreement, the Client confirms that he(she) is authorized andhas legal capacity to sign documents binding both Skycop and the Client or, if applicable, has a right to sign on behalf of another person(e.g. a child).
Укладаючи договір, Клієнт підтверджує, що він уповноважений та має дієздатність підписувати документи,що зобов'язують і Skycop, і Клієнта, або, якщо це необхідно, має право підписувати від імені іншої особи(наприклад, дитини).Skycop will use the Client's and, if applicable, its employees' personal data exclusively for enforcing the Claim.
Skycop використовує персональні дані Клієнта і, якщо застосовується, працівників Клієнта виключно лише з метою розгляду Заявки.If the Client receives any payment or any other type of the Flight Compensation, e.g. flight voucher, from the flight operating carrier after engaging Skycop's services,the Client is obligated to inform Skycop immediately.

Після отримання таких даних Skycop проводить оцінку рейсу і встановлює, чи є ймовірним на підставі поданої Клієнтом інформації успішне завершення Претензії.The Client understands that by making Assignment he/she may not conclude the same and/or any similar agreement,including companies competing with Skycop to act in the interest of the Client, take legal action in relation to collection of the Flight Compensation.
Клієнт розуміє, що в разі передачі Вимоги він не може укладати будь-яких аналогічних і/ або схожих договорів,в тому числі і з конкурентами Skycop, які прагнуть захисту інтересів Клієнта, робити юридичні дії щодо стягнення Компенсації.If you do that, Skycop will be the one checking whether the flight is eligible for compensation- and we have a crack team of professionals who are really good at investigating things like that.
Якщо ви це зробите, Skycop перевірить, чи цей рейс дає вам право на компенсацію- і у нас є відмінна команда професіоналів, які дуже добре розслідують подібні речі.Only where the Assignment agreement(form) is declared invalid or cannot be considered valid in the particular jurisdiction(country), the Agreement concluded between the Client and Skycop shall be considered as a contract for services according to which Skycop administers Client‘s Assignment and undertakes to organize and finance the collection of the Assignment and to execute all other actions in relation to the Agreement.
Виключно в тому випадку, якщо Угода про поступку вимоги визнається недійсною або не може визнаватися дійсною в певній юрисдикції(державі), в такому випадку укладений між Клієнтом і Skycop Договір вважається договором про надання послуг, відповідно до якого Skycop адмініструє Вимогу Кліента і приймає на себе обов'язки в організації та фінансування діяльності, а також виконання всіх пов'язаних з ними дій, що обумовлені в Договорі.That's why Skycop has embarked on a mission to make sure that every single passenger, who's experienced flight delays, cancellation or overbooking, gets their compensation from the airlines.
Skycop взяв на себе місію забезпечити, щоб кожен пасажир, який зіткнувся із затримками, скасуванням чи перебронюванням, отримав належну йому компенсацію від авіакомпанії.If settlement agreement with a flight operating carrier is not reached regarding the Claim or in other cases, when, in Skycop's opinion, Flight Compensation recovery process would be more effective and(or) quicker, Skycop is entitled to commence Legal Proceedings, which will result in the increase of the part of the Flight Compensation belonging to Skycop, as specified in the Price List.
Якщо угода про врегулювання з авіаперевізником не досягнута щодо Вимоги або в інших випадках, коли, на думку Skycop, процес стягнення Компенсації за рейс є більш ефективним і(або) швидшим, Skycop має право розпочати Юридичне провадження, яке призведе до збільшення частини Компенсації за рейс, яка належить Skycop, як зазначено в Прайс-листі.Skycop shall not be liable for any checks, prepaid debit cards, credit cards and similar means which are lost by the Client as well as for any effect of the Client giving wrong bank account information.
Skycop не несе відповідальності за будь-які чеки, дебетові карти передоплати, кредитні карти і подібні до них засоби, які втрачені Клієнтом, а також і в тих випадках, коли Клієнт вказує недостовірну банківську інформацію.In case of any doubt regarding the right to receive payments, Skycop has the right to request additional proof confirming the right to accept payments on behalf of the final beneficiaries and(or) unilaterally refuse to pay the Flight Compensation directly to such person.
При виникненні будь-яких сумнівів щодо права на прийняття платежів, Skycop має право вимагати додаткові докази, що підтверджують право на прийняття платежів від імені кінцевих одержувачів, і/ або в односторонньому порядку відмовитися виплачувати Компенсацію особі, якій вона не належить безпосередньо.Skycop will amend T&C by replacing such illegal, invalid or unenforceable provisions with legal, valid and enforceable provisions that would produce the result as close as possible to the intentions of Skycop and the Client.
Skycop замінить такі незаконні, недійсні або нездійсненні положення законними, дійсними або здійсненними положеннями, які за своїм значенням будуть наскільки це можливо близькими до намірів Skycop і Клієнта.If the Client provides incorrect or incomplete data or if the Client withheld from Skycop that the Client has already received the Flight Compensation from the flight operating carrier for the respective Claim and Skycop is not able to collect the Flight Compensation or losses through the Legal Proceedings, Skycop reserves the right to assert its claim against the Client for the resulting damage.
Якщо Клієнт надає недостовірні або неповні дані або якщо Клієнт приховав від Skycop те, що Клієнт вже отримав Компенсацію за рейс від авіаперевізника за відповідною Вимогою, а Skycop не в змозі отримати компенсацію або несе збитки в рамках Юридичного провадження, Skycop залишає за собою право подати свою претензію до Клієнта за заподіяну шкоду.Skycop uses online authentication service for advanced electronic signatures complying with requirements set forth in Article 26 of the Electronic Identification Regulation that is internationally recognised and accepted even by courts, so the Client does not have to print, sign and return the Agreement by registered mail.
Skycop використовує електронну послугу аутентифікації сучасних електронних підписів, що відповідає викладеним у статті 26 Регламенту електронної ідентифікації вимогам, визнаним в міжнародному масштабі, навіть і судами, тому Клієнту не треба роздруковувати, підписувати та надсилати Договір заказною поштою.In such case, the Client and Skycop will settle between each other according to the terms and conditions specified in these T&C and(or) other agreement concluded by and between the Client and Skycop.
У такому випадку Клієнт та Skycop проводять розрахунки між собою відповідно до умов, зазначених у цих Умовах та(або) інших угодах, укладених між Клієнтом та Skycop.If Skycop estimates that the flight data provided by the Client is sufficient and Claim could be successful, Skycop shall execute all necessary actions in relation to the collection of Client's Flight Compensation according to the documents signed and approved by the Client.
Якщо Skycop встановлює, що представлена Клієнтом інформація про рейс є достатньою і успішне завершення Претензії є ймовірним, за підписаними і завіреним Клієнтом документів Skycop виконує всі дії, необхідні для стягнення Компенсації Клієнта.At the same time the Client agrees with Skycop that all Flight Compensation payments made by operating carriers under Skycop‘s Claims should be made directly to the bank accounts owned by Skycop or other bank accounts as agreed by Skycop and the Client.
Одночасно з цим Клієнт домовляється з Skycop про те, що всі платежі перевізників зі сплати Компенсацій будуть проводитися безпосередньо на належні Skycop або інші банківські рахунки, в залежності від домовленості між Skycop і Клієнтом.Skycop shall not pay Flight Compensation and(or) any other payments to intermediaries, agencies, representatives and(or) other third parties which, together with the request for payment of the Flight Compensation do not provide any specific written proof clearly and unambiguously confirming the authority to accept payments on behalf of the final beneficiary.
Skycop не виплачує Компенсацію і(або) будь-яких інших платежів посередникам, агентствам, представникам і/ або іншим третім особам, які одночасно із заявою про виплату Компенсації не пропонують конкретних письмових доказів, чітко і без сумніву підтверджують повноваження на прийняття платежів від імені кінцевого одержувача.For the purposes of this Agreement Skycop will be acting as a data processor, rather than as a data controller(as they are understood under the Privacy and Data Protection Requirements), in respect of all such data processing activities which Skycop may carry out under this Agreement.
З метою цього Договору Skycop буде діяти як розпорядник даних, а не як керівник ними(як вони розуміються згідно з Вимогами конфіденційності та захисту даних), в ході здійснення всіх операцій з обробки даних, які можуть бути зроблені при виконанні Skycop його зобов'язань за цим Договором.Proceedings” shall mean a process when Skycop files the Claim to a court, alternative dispute resolution institutions, aviation regulatory agencies, consumer protection agencies and/or governmental bodies or handling over the Claim to a contracted legal representative, such as an attorney or law firm.
Юридичне провадження» означає процес, коли Skycop подає Вимогу до суду, установ альтернативного вирішення спорів, органів управління цивільною авіацією, органів захисту прав споживачів та/або урядових органів або передає Вимогу найнятому юридичному представникові, наприклад, адвокатові або юридичній фірмі.Legal Proceedings” shall mean a process when Skycop files the Claim to a court, alternative dispute resolution institutions, aviation regulatory agencies, consumer protection agencies and/or governmental bodies or handling over the Claim to a contracted legal representative, such as an attorney or law firm.
Розгляд» означає процес, коли Skycop представляє Заявку в суд, органам альтернативного розгляду спорів, інституціям з авіаційного регулювання, інституціям з захисту прав споживачів і(або) органів державної влади або передає Заявку юридичному представнику, який діє на підставі договору, такому як адвокат або адвокатська контора.In such case, the Client shall be obliged to pay Skycop the commission, indicated in Section 3.2 or 3.3, in 10(ten) days from the day the Flight Compensation is received from the flight operating carrierto the bank account provided in the contact column of Skycop's website or any other bank account provided by Skycop in a written form.
В такому випадку Клієнт зобов'язується сплатити Skycop винагороду, зазначену в пункті 3. 2 або 3. 3, протягом 10(десяти) днів з дати отримання Компенсації за рейс від авіаперевізника на банківський рахунок, наданий у стовбці контактів на веб-сайті Skycop, або на будь-який інший банківський рахунок, наданий Skycop у письмовій формі.
