Article 9 Administrative formalities for family members who are not nationals of a Member State.
Family members who are not nationals of a Member State shall only be required to have an entry visa in accordance with Regulation(EC) No 539/2001 or, where appropriate, with national law.

When issuing residence cards to family members of Union citizens who are not nationals of a Member State, Member States shall use the same format as established by Regulation(EC) No 1030/2002 as amended by Regulation(EU) 2017/1954, and as implemented by Implementing Decision C(2018) 7767.
As set out in Article 5(1),‘Member States shall grant Union citizens leave to enter their territory… andshall grant family members who are not nationals of a Member State leave to enter their territory with a valid passport'.
As regards residence documents issued to family members who are not nationals of a Member State, it is appropriate to make use of the same format and security features as those provided for in Regulation(EC) No 1030/2002 as amended by Regulation(EU) 2017/1954 of the European Parliament and of the Council(8).
(13) The residence card requirement should be restricted to family members of Union citizens who are not nationals of a Member State for periods of residence of longer than three months.
The right of residence provided for in paragraph 1 shall extend to family members who are not nationals of a Member State, accompanying or joining the Union citizen in the host Member State, provided that such Union citizen satisfies the conditions referred to in paragraph 1…(b)….
The same requirement of accompanying or joining the Union citizen is furthermore repeated in Articles 6(2) and 7(2)of Directive 2004/38 in connection with the extension of the citizen's right of residence to his family members who are not nationals of a Member State, and also in Article 10(2)(c) in connection with the issue of the residence card provided for by that directive.
The right of residence of family members of a Union citizen who are not nationals of a Member State shall be evidenced by the issuing of a document called“Residence card of a family member of a Union citizen” no later than six months from the date on which they submit the application.
The establishment of minimum security standards and the integration of biometric data in identity cards andin residence cards of family members who are not nationals of a Member State is an important step to render their use in the Union more secure.
The right of residence provided for in paragraph 1 shall extend to family members who are not nationals of a Member State, accompanying or joining the Union citizen in the host Member State…'.
Member States shall issue a residence card to family members of a Union citizen who are not nationals of a Member State, where the planned stay is for more than six months.

Pursuant to that Directive, Member States are also required to issue residence cards to family members who are not nationals of a Member State and, on application, to issue documents certifying permanent residence and to issue permanent residence cards.
The introduction of security standards in identity cards andin residence cards of family members who are not nationals of a Member State should not result in a disproportionate increase in fees for Union citizens or third-country nationals. .
Thus, there is nothing at all in Article 5 indicating that the right of entry of family members of the Union citizen who are not nationals of a Member State is limited to Member States other than the Member State of origin of the Union citizen.
Without prejudice to the second subparagraph, the Union citizen's death shall not entail loss of the right of residence of his/her family members who are not nationals of a Member State and who have been residing in the host Member State as family members for at least one year before the Union citizen's death.
Unfortunately, important amendments by the Confederal Group of the European United Left/Nordic Green Left were rejected and, as a result,initiatives cannot be signed by EU residents who are not nationals of a Member State, thereby precluding equal participation of residents, regardless of nationality, nor is there a guarantee that signatures will tally with signatories' ID numbers.
