The Investigation of Marine Casualties and Incidents.
A high general level of safety should be maintained in maritime transport and every effort should be made to reduce the number of marine casualties and incidents.
Safety investigations shall follow the principles of the common methodology for investigating marine casualties and incidents developed pursuant to Article 2(e) of Regulation(EC) No 1406/2002.
It shares the aim of the European Parliament to establish a framework ensuring rapid safety investigations into maritime casualties and incidents.
Related to the methodology for investigating marine casualties and incidents, the Council deems it appropriate to provide for more flexibility, while establishing the bases for a continuous exchange of experience.
This Directive shall apply to marine casualties and incidents that.
The proposal aims at improving safety by establishing clear Community-wide rules on the independent technical investigations to be carried out following maritime casualties and incidents.
The investigative bodies of the Member States shall notify the Commission on marine casualties and incidents in accordance with the format in Annex II.
The proposal is drawn up in compliance with the rules of international maritime law and in accordance with the definitions and recommendations in the IMO Code for the Investigation of Marine Casualties and Incidents.
When carrying out safety investigations, the investigative body shall follow the common methodology for investigating marine casualties and incidents developed pursuant to Article 2(e) of Regulation(EC) No 1406/2002.

In the event of other marine casualties and marine incidents, the Safety Investigation Bureau shall carry out assessment in order to decide whether or not to undertake a safety investigation, taking into account the seriousness of the marine casualty or marine incident, the type of vessel and cargo involved, and the potential for the findings of the safety investigation to lead to the prevention of future casualties and incidents.
