Commission Decision 2001/497/EC of 15 June 2001 on standard contractual clauses for the transfer of personal data to third countries under Directive 95/46/EC(2) therefore lays down a model set of standard contractual clauses which ensures adequate safeguards for the transfer of data to third countries.
(2) Commission Decision 2004/915/EC of 27 December 2004 amending Decision 2001/497/EC as regards the introduction of an alternative set of standard contractual clauses for the transfer of personal data to third countries[2] is to be incorporated into the Agreement.
Whenever the Data is transferred outside the EEA, the Company shall take all appropriate contractual measures necessary to ensure an adequate level of Data protection, including- among others- the agreements based on the standard contractual clauses for the transfer of data outside the EEA, approved by the European Commission.

As regards the transfer of Personal Data outside the EEA, we have established appropriate data transfer processing agreements based on standard data protection clauses adopted by the EU Commission in accordance with applicable law(see i.e. Article 46(2)(c)of the GDPR as well as EU Commission Decision 2010/87 of 5 February 2010 on standard contractual clauses for the transfer of personal data to processors established in third countries).
In the unlikely case that data are re-identified after transfer, the security of your data will be protected by appropriate safeguards, including but not limited to Model Clauses pursuant tothe European Commission's decision(C(2010)593) of 5 February 2010 on Standard Contractual Clauses for the transfer of personal data to processors established in third countries which do not ensure an adequate level of data protection(“Model Clauses”).
By way of data transfer agreement,incorporating the current standard contractual clauses adopted by the European Commission for the transfer of personal data by controllers in the EEA to controllers and processors in jurisdictions without adequate data protection laws;
Through a data transfer agreement incorporating the current standard contractual clauses adopted by the European Commission for the transfer of personal data by data controllers in the EEA to controllers and subcontractors in jurisdictions lacking adequate data protection legislation; or.
That the transfer will be based on the standard data protection clauses for transfer of personal data to countries outside of the EU/EEA adopted by the European Commission a copy of these standard data protection clauses can be found at WEB.
