The provisions of this Treaty shall not be invoked so as to prevent the implementation of agreements or contracts concluded before 1 January 1958 or,for acceding States, before the date of their accession, by a Member State, a person or an undertaking with a third State, an international organisation or a national of a third State where such agreements or contracts have been communicated to the Commission not later than 30 days after the aforesaid dates. .
However, Member States may retain the rules in force at 1 January 1979 or,in the case of the Member States which acceded to the Community after that date, on the date of their accession.
The provisions of this Treaty shall not be invoked so as to prevent the implementation of agreements or contracts concluded before 1 January 1958 or,for acceding States, before the date of their accession, by a Member State, a person or an undertaking with a third State, an international organisation or a national of a third State where such agreements or contracts have been communicated to the Commission not later than 30 days after the aforesaid dates. .
(b) in the second paragraph, the words'concluded between the signature and the entry into force of this Treaty' shall be replaced by'concluded between 25 March 1957 and 1 January 1958 or, for acceding States,between the signature of the instrument of accession and the date of their accession'.
Until the provisions referred to in Article 71(1) have been laid down, no Member State may, without the unanimous approval of the Council, make the various provisions governing the subject on 1 January 1958 or,for acceding States, the date of their accession less favourable in their direct or indirect effect on carriers of other Member States as compared with carriers who are nationals of that State.
Pending the entry into force of the provisions referred to in the first paragraph, Member States may retain all the exclusions provided for under their national laws at 1 January 1979 or,in the case of the Member States which acceded to the Community after that date, on the date of their accession.
Until the provisions referred to in Article 71(1) have been laid down, no Member State may, without the unanimous approval of the Council, make the various provisions governing the subject on 1 January 1958 or,for acceding States, the date of their accession less favourable in their direct or indirect effect on carriers of other Member States as compared with carriers who are nationals of that State.
Pending the entry into force of the provisions referred to in the first paragraph, Member States may retain all the exclusions provided for under their national laws at 1 January 1979 or,in the case of the Member States which acceded to the Community after that date, on the date of their accession.
Thus, the Berne Convention displays the characteristics of an international agreement for the purposes of Article 351 TFEU, which provides inter alia that the rights and obligations arising from agreements concluded before 1 January 1958, or,for acceding States, before the date of their accession, between one or more Member States, on the one hand, and one or more third countries, on the other, are not to be affected by the provisions of the Treaties.
Pending the entry into force of the provisions referred to in the first paragraph, Member States may retain all the exclusions provided for under their national laws at 1 January 1979 or,in the case of the Member States which acceded to the Community after that date, on the date of their accession.
No person or undertaking concluding or renewing an agreement or contract with a third State, an international organisation or a national of a third State after 1 January 1958 or,for acceding States, after the date of their accession, may invoke that agreement or contract in order to evade the obligations imposed by this Treaty.
Until the European laws or framework laws referred to in the first paragraph of Article III-134 have been adopted, no Member State may, unless the Council of Ministers has unanimously adopted a European decision granting a derogation, make the various provisions governing the subject on 1 January 1958 or,for acceding States, the date of their accession less favourable in their direct or indirect effect on carriers of other Member States as compared with carriers who are nationals of that State.
The Republic of Lithuania adds that the objective of the second paragraph of Article 307 EC is not to ensure formal compliance with Community law on the part of the provisions of international agreements entered into by the Member States, but to ensure effective application of the provisions of Community law, in particular where the Member States have,prior to the respective dates of their accession, concluded international agreements with third countries on the same matters.
Up until the last minute, Bulgaria and Romania had hoped they would receive a clearanswer on Tuesday(May 16) regarding the date of their EU accession.
