The Union shall facilitate access to justice,in particular through the principle of mutual recognition of judicial and extrajudicial decisions in civil matters.

With the exceptionof cases involving minors, the enforcement of decisions in civil and commercial matters is governed by Act No 233/1995 on enforcement agents and enforcement proceedings, amending certain laws, as amended(the Enforcement Code)(Exekučný poriadok), under which only a decision that has the attribute of enforceability is an enforceable title.

The main policy objective in the area of civil procedural law is that borders between Member States should not constitute an obstacle either to the settlement of civil matters or to initiating court proceedings, or to the enforcement of decisions in civil matters.
It will allow the mutual recognition andenforcement of an agreement throughout the EU under the same conditions as those established for court decisions in civil and commercial matters and in matrimonial matters and matters of parental responsibility.
(3) The Union has set itself the objective of maintaining and developing an area of freedom, security and justice, inter alia, by facilitating access to justice,in particular through the principle of mutual recognition of judicial and extra-judicial decisions in civil matters.….
Urges the building of a consistent body of law, including rules governing access to justice, jurisdiction, the recognition andenforcement of judicial decisions in civil and commercial matters, the applicable law, and judicial assistance in cross-border situations involving third countries;
Paragraph 4 of that article provides that the Union is to facilitate access to justice,in particular through the principle of mutual recognition of judicial and extrajudicial decisions in civil matters.
The prosecutor's office shall exercise supervision of implementation of laws at investigation of crimes,of the conformity to the law of court decisions in civil, criminal cases and administrative offences, in instances provided by law, shall carry out preliminary investigation, and present state charges in the courts.
The first condition is met by limiting the proposed regulation to bilateral agreements in the areas of jurisdiction and recognition andenforcement of judgments and decisions in civil and commercial matters.
(2) The Procurators Office shall supervise the implementation of laws in the investigation of crimes,the conformity to the law of judicial decisions in civil and criminal cases and cases involving administrative offenses, and in the instances specified in law, conduct preliminary inquiries and support public prosecutions in the courts.
(4) On 30 November 2000, the Council adopted a programme of measures for implementation of the principle of mutual recognition of decisions in civil and commercial matters(5).
Of the EC Treaty, the Community may adopt“insofar as necessary for the proper functioning of the internal market” measures“improving andsimplifying… the recognition and enforcement of decisions in civil and commercial cases, including decisions in extra-judicial cases”,“promoting the compatibility of the rules applicable in the Member States concerning the conflict of laws and of jurisdiction” and“eliminating obstacles to the good functioning of civil proceedings”.

The European Union has established the objective of maintaining and developing an area of freedom, security and justice, inter alia, by facilitating access to justice,in particular through the principle of mutual recognition of judicial and extrajudicial decisions in civil matters.
Accordingly, Article 65 EC, on which Regulation No 44/2001 is based, expressly grants authority to adopt measures for the improvement and simplification of the recognition and enforcement of decisions in civil and commercial cases, including decisions in extrajudicial cases, in so far as necessary for the proper functioning of the internal market.
It should also be observed that according to recitals 10 and 11 in the preamble to Directive 2004/48, the directive aims to approximate the legislative systems of the Member States so as to ensure a high, equivalent and homogeneous level of protection in the internal market, and not to establish harmonised rules for judicial cooperation, jurisdiction,the recognition and enforcement of decisions in civil and commercial matters, or deal with applicable law.

This Directive is not intended to harmonise the rules applicable to judicial co-operation, judicial powers,the recognition and enforcement of decisions in civil and commercial matters, nor to set out the applicable law.
Whereas pursuant to Article 67(4) TFEU the Union should facilitate access to justice,particularly through the principle of mutual recognition of judicial and extrajudicial decisions in civil matters, as exemplified in Article 81 TFEU;
A circuit court reviews the decisions made in civil matters by the county courts within its territorial jurisdiction on the basis of appeals and appeals against rulings filed against the decisions of the county courts.
