The office of President of the Mixed Committee shall be held.
The Mixed Committee shall adopt its own Rules of Procedure by consensus.
The Swiss Government's representatives shall have the right to put forward suggestions in the Mixed Committee as regards the matters referred to in paragraph 1.
The Mixed Committee shall meet at the initiative of its President or at the request of any of its members.
The representatives of the governments of the United Kingdom shall have the right to make suggestions in the Mixed Committee relating to the matters mentioned in Article 1.
In the Mixed Committee at the ministerial level, the representatives of Iceland and Norway shall have the opportunity.
Any notification by Ireland orthe United Kingdom pursuant to Article 5 of the Schengen Protocol shall also be conveyed to Iceland and Norway within the Mixed Committee.
Meetings of the Mixed Committee at ministerial level shall be prepared by the Mixed Committee at the level of senior officials.
In this context, due account shall be taken of the time indicated by Iceland or Norway in the Mixed Committee as the time necessary to enable Iceland or Norway to fulfil their constitutional requirements.
The Mixed Committee shall have 90 days to settle the dispute, counting from the date of adoption of the agenda on which the dispute has been placed.
This Agreement shall be considered terminated, unless the Mixed Committee, after a careful examination of ways to continue the Agreement, decides otherwise within ninety days.
The Mixed Committee shall have ninety days from the date of the adoption of the agenda on which the dispute has been entered within which to settle the dispute.
The EEUPC costs and financing should be regularly monitored by the Mixed Committee, and the level of the court fees should be reviewed periodically, in accordance with point 31 above.
The Mixed Committee shall examine the matter which gave rise to suspension and shall endeavour to deal with the causes of non-acceptance or non-ratification within 90 days.
If Switzerland cannot implement the act or measure at issue on a provisional basis, and if this causes difficulties that disrupt the operation of Dublin/Eurodac cooperation,the situation shall be examined by the Mixed Committee.
Subject to Article 4(2), the Mixed Committee meets at the level of Ministers, senior officials or experts, as circumstances require.
If Switzerland cannot implement the act or measure at issue on a provisional basis, and if this causes difficulties that disrupt the operation of Dublin/Eurodac cooperation,the situation shall be examined by the Mixed Committee.
The court fees should be fixed by the Mixed Committee on a proposal by the Commission which should include an assessment by the Commission of the expected costs of the EEUPC.
At the end of the transitional period, on the basis of a report from the Commission on costs andfinancing of the EEUPC, the Mixed Committee should consider the adoption of measures aimed at the objective of self-financing.
Without prejudice to Article 4, the Mixed Committee shall be informed about the preparation within the Council of any acts or measures which may be relevant to this Agreement.
In the case of a dispute about the application of this Agreement or in a case where the situation provided for in Article 10(2) occurs,the matter shall be officially entered as a matter of dispute on the agenda of the Mixed Committee at ministerial level.
The Mixed Committee shall address, in accordance with this Agreement, all matters covered by Article 2 and shall ensure that any concern entertained by the United Kingdom is duly considered.
In case Norway, Iceland, Switzerland or Liechtenstein do not accept an act amending or building upon the Dublin/Eurodac acquis, the respective agreements will be terminated,unless the Joint/Mixed Committee established by the agreements decides otherwise, by unanimity.
In a case where the dispute cannot be settled by the Mixed Committee within the period of ninety days envisaged in paragraph 2, a further period of thirty days shall be observed for reaching a final settlement.
CONSIDERING that for this purpose it is necessary to set up an organisational structure, outside the institutional framework of the European Union, ensuring the association of the Republic of Iceland and the Kingdom of Norway with the decision-making process in these fields andenabling their participation in these activities through a Mixed Committee.
Where the dispute cannot be settled by the Mixed Committee within the 90-day deadline provided for in paragraph 2, this deadline shall be extended by a further 90 days with a view to reaching a final settlement.
A Mixed Committee is hereby established, consisting of representatives of the government of the United Kingdom, the members of the Council of the European Union, hereinafter referred to as the"Council", and of the Commission of the European Communities, hereinafter referred to as the"Commission".
The United Kingdom shall submit reports annually to the Mixed Committee on the way in which its administrative authorities and courts have applied and interpreted the provisions referred to in Article 2, as interpreted by the Court of Justice, as the case may be.
Each year Switzerland shall report to the Mixed Committee on the way in which its administrative authorities and courts have applied and interpreted the provisions referred to in Article 1, as interpreted, where relevant, by the Court of Justice.
