(10) In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission.
Our interpretation of Article 290 is that this gives the Commission the opportunity to supplement or amend legislation.
In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union(TFEU) should be delegated to the Commission.
The Commission shall be empowered to adopt delegated acts in accordance with Article 34 to supplement or amend these rates.
The Commission is empowered to adopt delegated acts in accordance with Article 38 to supplement or amend the indicators in Annex III where considered necessary to ensure effective assessment of progress in the implementation of the strands.

Delegated regulations are‘non-legislative acts of general application to supplement or amend certain non-essential elements of a legislative act'(Article 290 of the Treaty on the Functioning of the European Union); 4 Period from the submission of the first PA/OP to the adoption of the last PA/OP.
The Commission shall be empowered to adopt delegated acts in accordance with Article 34 to supplement or amend these rates, and the financial amounts involved.
(12)In order to supplement or amend Directive 1999/31/EC, in particular with the view to adapting its Annexes to scientific and technical progress, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of Article 16.

Amendment(1) The Treaty of Lisbon introduced a distinction between powers delegated to the Commission to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of a legislative act(delegated acts), and the powers conferred upon the Commission to adopt acts to ensure uniform conditions for implementing legally binding Union acts(implementing acts).
However, I regret having to point out the Council's refusal to apply Article 290 of the Treaty on the Functioning of the European Union(TFEU),which delegates to the Commission'the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of the legislative act'.
In areas where the Commission is currently empowered by Directive 2009/138/EC to adopt implementing measures, where those measures are non-legislative acts of general application to supplement or amend certain non-essential elements of that Directive in the sense of Article 290 TFEU, the Commission should be empowered to adopt delegated acts in accordance with that Article or regulatory technical standards in accordance with Articles 10 to 14 of Regulation(EU) No 1094/2010.
(8) The Treaty of Lisbon introduced the possibility for the legislator to delegate power to the Commission to adopt non- legislative acts of general application to supplement or amend certain non- essential elements of a legislative act.
This allows the legislator to delegate to the Commission the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of a legislative act(quasi-legislative acts).
Article 290 TFEU provides that a legislative act may delegate to the Commission the power to adopt non-legislative acts of general application to supplement or amend non-essential elements of the legislative act.
The Commission is empowered to adopt delegated acts in accordance with Article 50 concerning amendments to Annex V to supplement or amend the impact pathway indicators, where considered necessary, and set baselines and targets.
That is the framework for this new instrument, which allows the legislator to delegate part of its powers to the Commission(Article 290 of the Treaty on the Functioning of the European Union),provided that it is an act of general application that is used to supplement or amend parts of a legislative act that are not considered essential.
(16) In areas where the Commission is currently empowered by Directive 2009/138/EC to adopt implementing measures where these measures are non-legislative acts of general application to supplement or amend certain non-essential elements of that Directive in the sense of Article 290 TFEU, the Commission should be empowered to adopt delegated acts in accordance with that Article.
A legislative act may delegate to the Commission the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of the legislative act.
It gives the legislator the possibility to delegate on the Commission the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of the legislative act.
Article 290 of TFEU allows the legislator to delegate to the Commission the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of a legislative act.
Article 290(1) of the Treaty states that a legislative act may delegate to the Commission the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of the legislative act.
