Free Use of Works.
Bulgarian Law on Copyright andRelated Rights sets the exceptions and limitations to copyright in its Chapter V-“Free Use of Works”.

Member States may provide for exceptions or limitations to the rights provided for in Articles 2 and3 in the following cases…(h) use of works, such as works of architecture or sculpture, made to be located permanently in public places”.

This should significantly facilitate the use of works that are no longer commercially available, while ensuring that the rights of copyright-holders are fully safeguarded.

Free use of works is only permissible in the cases defined in the law, provided that the normal use of the work is not prevented and the legal interests of the copyright holder are not violated.
However, Article 5(3)(n) of the directive limits the use of works, within the meaning of that provision, to the‘communication or making available' of those works and thus to acts which fall under the sole exclusive right of communication to the public of works referred to in Article 3 of that directive.
