Whose agricultural activities form only an insignificant part of their overall economic activities; and/or.
Active farmer: Farmers who either carry out minimum activities on land naturally kept in a state suitable for grazing or cultivation or whose agricultural activities are not marginal.
By this, MS may exclude beneficiaries whose agricultural activities form only an insignificant part of their overall economic activities or who do not exercise any agricultural activity at all.

MS may also decide not to award direct payments to enterprises whose agricultural activities form only an insignificant part of their economic activities, or whose principal activity is not agricultural. .
The issue of the farmer definition referred to by the Court has been addressed in the framework of the Health Check by giving Member States the possibility to exclude natural orlegal persons from the direct payment schemes whose principal business objects do not consist of exercising an agricultural activity or whose agricultural activities are insignificant(Article 28(2) of Regu lation(EC) No 73/2009).
The definition must ensure that no support can be granted to those whose agricultural activity forms only an insignificant part of their overall economic activities or those whose principal business activity is not agricultural. .
It has proposed that Member States should exclude natural orlegal persons from the direct payment schemes whose business objects do not consist of agricultural activities or whose agricultural activities are insignificant. However, the Council made this provision optional for Member States(Article 28(2) of Regu lation(EC) No 73/2009).
Hogan sees a genuine farmer as one where no support is granted to those whose agricultural activity forms only an insignificant part of their overall economic activities or whose principal business activity is not agricultural, while not precluding from support pluri-active farmers.
In 2008, the Commission and the Council undertook a review of the CAP, known as the‘Health Check', which led to the acknowledgement that SPS aid should not go to‘natural orlegal persons whose agricultural activities form only an insignificant part of their overall economic activities or whose principal business or company objects do not consist of exercising an agricultural activity'.
Also, Member States were entitled to generally refrain from paying support to persons whose agricultural activities formed only an insignificant part of their overall economic activities or whose principal business objects did not consist of agriculture.
The commission has also outlined that the definition must ensure that“no support” can be granted to those whose agricultural activity forms“only an insignificant part” of their overall economic activity, or those whose principal business activity is not agricultural. .
Following the introduction of the SPS, the Court has identified a number of new beneficiaries whose agricultural activities form only an insignificant part of their overall economic activities or whose principal business does not consist of exercising an agricultural activity.
From 2010, Member States have had the possibility to exclude from the benefit of direct payment natural orlegal persons whose agricultural activities form only an insignificant part of their overall economic activities or whose principal business or company objectives do not consist of exercising an agricultural activity.
Member States were entitled to adopt tighter rules by adding further businesses to the list orby generally excluding all persons whose agricultural activities formed only an insignificant part of their overall economic activities or whose principal business activities did not consist of carrying out agricultural activities.
(d)'genuine farmers' shall be defined in a way to ensure that no support is granted to those whose agricultural activity forms only an insignificant part of their overall economic activities or whose principal business activity is not agricultural, while not precluding from support pluri-active farmers.
During the Health Check, it was acknowledged that agricultural income support should not be allocated to‘natural orlegal persons whose agricultural activities form only an insignificant part of their overall economic activities or whose principal business or company objects do not consist of exercising an agricultural activity'24.
(d)'genuine farmers' shallmay be defined, where the Member States so decides,in a way to ensure that no support is granted to those whose agricultural activity forms only an insignificant part of their overall economic activities or whose principal business activity is not agricultural, while not precluding from support pluri-active farmers.
For beneficiaries applying for direct payments under the schemes listed in Annex I to Regulation(EU)No 1307/2013 and whose agricultural areas are mainly areas naturally kept in a state suitable for grazing or cultivation, the on-the-spot check shall also cover the verification of the minimum activity carried out on those areas as referred to in Article 9(1) of Regulation(EU) No 1307/2013.
