Istovremeno, član 14. stav 2. Zakona o javnom informisanju predviđa da osnivači javnog glasila ne mogu biti, ni posredno ni neposredno, država i teritorijalna autonomija, kao ni ustanova, preduzeće i drugo pravno lice koje je u pretežnom delu u državnoj svojini ili koje se u celini ili pretežnim delom finansira iz javnih prihoda, osim ukolikoje to predviđeno posebnim zakonom kojim se uređuje oblast radiodifuzije.Article 8, paragraph 2, subparagraph 3 of the Broadcasting Law says that the RBA shall perform tasks related to taking measures in the field of broadcasting, with the aim of preventing the broadcasting of programs containing information inciting discrimination, hatred or violence against persons or groups of persons for their ethnic, religious, national affiliation or gender.

Što se tiče prvog programa RTV-a, konstatuje se da je, imajući u viduraznovrsnost programske ponude, ispunjena zakonska obaveza iz člana 77 Zakona o PROCEDURE FOR ASSESSING THE CONSTITUTIONALITY OF CERTAIN PROVISIONS OF THE LAW ON CINEMATOGRAPHYThe Law on Cinematography, which the National Assembly of the Republic of Serbia adopted on 26 December 2011, contains certain provisions which are in direct collision with the existing regulations in the field of broadcasting and with the Media Strategy, and the application of which can adversely affect the functioning of broadcast media and the independence of broadcasting regulatory bodies.
POSTUPAK ZA OCENU USTAVNOSTI POJEDINIH ODREDABA ZAKONA O KINEMATOGRAFIJI Zakon Article 18 goes on detailing that the warning will be pronounced if a broadcaster is found to have: been in continuous non-compliance with the Law or a RBA act passed on the basis of the Law; violated for the first time oneof the statutory obligations, with the violation seriously undermining the realization of the principle of regulating relations in the field of broadcasting; violated any of the criteria contained in the issued broadcasting license.
U članu 18 Zakona dalje se navodi da se upozorenje izriče emiteru koji: i pored izrečene opomene nastavi da postupa suprotno obavezama utvrđenim zakonom ili aktom Agencije donetim na osnovu zakona; prvi put prekrši neku od obaveza utvrđenih zakonom, ali na način dato kršenje ozbiljno ugrožava ostvarivanje načela regulisanja odnosa u oblasti radiodifuzije; prekrši neki od uslova koji su sadržani u izdatoj dozvoli za emitovanje programa.(UNS, 11. oktobar 2011, Blic, 12.10.2011)The Republic Broadcasting Agency(RRA)The Council of the Republic Broadcasting Agency(RRA) has decided to issue the first 12 broadcasting licenses to cable broadcasters,in accordance with the Law on Broadcasting, thereby commencing the final phase of the regulation of broadcasting in the field of satellite and cable distribution of programme in Serbia.
