In accomplishing its task, the Community must ensure that normal conditions of competition are established, maintained and complied with.
It classes the cartel as a very serious infringement with a realimpact on the relevant EEA market in so far as it has led to price levels which were higher thanwould have been the case under normal conditions of competition.
To improve the situation and secure normal conditions of competition, an agreement has been concluded under the auspices of the OECD which should have entered into force on 1 January 1996.
In July, negotiations within the Organization for Economic Cooperation and Development(OECD)resulted in an agreement designed to ensure normal conditions of competition in commercial shipbuilding as from 1 January 1996.
In view of the outcome of the exploratory talks on restoring normal conditions of competition in the shipbuilding industry, the Council authorized the Commission, in July, to participate in formal negotiations initiated on this matter in the OECD.2.
It should also be noted that, between 1997 and the IP,the profitability achieved by the Community industry remained at a level lower than what the industry could expect under normal conditions of competition, in the absence of dumped imports.
In order to guarantee normal conditions of competition between producer organisations making use of the margin of tolerance provided for in Regulation(EC) No 104/2000, it is necessary to lay down rules which relate to its application and are consistent with other intervention mechanisms.
It is necessary to specify requirements pertaining to the application of the margin of tolerance provided for in Article 21(1)(a) of Regulation(EC)No 104/2000 in order to guarantee normal conditions of competition between producer organisations.

The Court stressed that the partial termination of the quota system contributed to the progressive restoration of normal conditions of competition, an objective the Commission had a duty to achieve under Articles 5 and 8 of the Treaty.3.

Article 4 of Regulation(EEC) No 2075/92 of 30 June 1992 on the common organisation of the market in raw tobacco(4) provides for the fixing of the amount of the premium and the supplementary amounts for each tobacco harvest, taking particular account of past andforeseeable possibilities for the disposal of the various types of tobacco, under normal conditions of competition.
Despite the fact that there was only one producer of the product in Poland and despite the existence of import duties on the product in respect of its import from a number of countries,the Polish domestic market for the product was subject to normal conditions of competition, and large quantities of the product to which no import duties were applied, were imported from different originating countries.
It should be noted that when calculating the amount of duty necessary to remove the effects of the injurious dumping, it was considered that any measures should allow the Community industry tocover its costs and obtain overall a profit before tax that could be reasonably achieved by the Community industry under normal conditions of competition, i.e. in the absence of dumped imports.
Finally, a decision adopted under Article 95 of the ECSC Treaty, such as the Code of 1993, must also take into account Article 5 of the Treaty, pursuant to which theCommunity is to ensure, inter alia, the maintenance of normal conditions of competition and is to exert direct influence on production or upon the market only when circumstances so require.
It follows that the profit margin to be used by the Council when calculating the target price that will remove the injury in question must be limited to the profit margin which the Community industry could reasonably count on under normal conditions of competition, in the absence of the dumped imports.
Having been informed by the Commission that the shipbuilding industry was still marked by structural imbalances and very low output both in the Com munity and world-wide, the Council held a debate on 14 November,during which it was stressed that any policy to restore normal conditions of competition should cover all forms of support and that any discussion of these problems should include the United States, Japan and South Korea.5.
When calculating the amount of duty necessary to remove the effects of the injurious subsidies, it was considered that any measures should allow the Community industry to cover its costs andobtain overall a profit before tax that could be reasonably achieved under normal conditions of competition, i.e. in the absence of subsidised imports, on the sales of the like product in the Community.
But here I come to the reason for our reservations- first andforemost because we cannot see that the amendment is necessary in itself to ensure uniform conditions of competition for normal or parallel investment undertakings.
Conditions of normal competition were restored in a number of areas in which distortions had been created through agreement between enterprises.
