The Accessibility requirements set out in Section IX of Annex I shall apply.

In order to maximise the foreseeable use by persons with disabilities,when the accessibility requirements, set out in Sections I to VI of this Annex, do not address one or more functions of the design and production of products or the provision of services those functions or means shall be accessible by complying with the related functional performance criteria.
Member States shall ensure that the products and services referred to in Article 1(1) and1(2) comply with the accessibility requirements set out in Annex I in accordance with paragraphs 2 to 9 of this Article.
Likewise, there should not be any legitimate reasons for not procuring or developing software systems to manage content on websites and mobile applications in an accessible manner, since sufficient andadvisory techniques are available to make those systems meet the accessibility requirements set out in this Directive.
Member States shall periodically monitor the compliance of websites andmobile applications of public sector bodies with the accessibility requirements set out in Article 4 on the basis of the monitoring methodology provided for in paragraph 2 of this Article.
Therefore, this Directive should enable Member States to include the built environment used in the provision of the services under the scope of this Directive,ensuring compliance with the accessibility requirements set out in Annex III.
Any product or service, the features, elements orfunctions of which comply with the accessibility requirements set out in Annex I to this Directive in accordance with Section VI thereof shall be presumed to fulfil the relevant obligations set out in Union acts other than this Directive, as regards accessibility, for those features, elements or functions, unless otherwise provided in those other acts.▌▌.
It is important that Member States,in close cooperation with the Commission, should promote the use of authoring tools that allow better implementation of the accessibility requirements set out in this Directive.
With the purpose of, notably, ensuring that relevant authorities implement the same accessibility requirements independently of the type of regulated website, the accessibility requirements set out in this Directive should be aligned to those of the proposed Directive on the accessibility of public sector bodies' websites.
Member States shall ensure, in accordance with paragraphs 2, 3 and 5 of this Article andsubject to Article 14, that economic operators only place on the market products and only provide services that comply with the accessibility requirements set out in Annex I.
A feedback mechanism should be set up to enable any person to notify the public sector body concerned of any failures of the website ormobile applications to comply with the accessibility requirements set out in this Directive and to request information excluded.
Without prejudice to paragraph 5 of this Article, all services, except for urban and suburban transport services andregional transport services, shall comply with the accessibility requirements set out in Section III of Annex I.▌.
Regulation(EU) No 1025/2012 also provides for the procedures for objections to harmonised standards where those standards do not entirely satisfy the accessibility requirements set out in this Directive.
Where no references to the harmonised standards referred to in paragraph 1 of this Article have been published, content of mobile applications that meets the technical specifications orparts thereof shall be presumed to be in conformity with the accessibility requirements set out in Article 4 that are covered by those technical specifications or by parts thereof.
