Chapter II Import and export licences.

(7) If the system of import and export licences is to operate correctly, a certain minimum amount of information should be given in the licences. .

(4) Commission Regulation(EC)No 1291/2000 lays down common detailed rules for applying the system of import and export licences and advance fixing certificates for agricultural products(12).
Against this background and in the light of the experience gained in the CMOs where the management of licences is alreadyconferred on the Commission, it appears appropriate to extend this approach to all sectors where import and export licences are being used.
Some operations relate to small quantities and, in the interests of simplifying administrative procedures, import and export licences and advance-fixing certificates should not be required for such operations.
Before issuing import and export licences the Commission should be enabled to verify with the competent authorities of the third country concerned whether the intended transaction would comply with the requirements applicable in that country, in order to avoid illegal and unwanted trade.
(8) Under the Community rules governing the various sectors covered by the common organisation of agricultural markets, import and export licences and advance fixing certificates are applicable to operations effected in the Community.

Whereas Commission Regulation(EEC) No 3719/88(3), as last amended by Regulation(EC) No 1199/95(4),lays down detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products;
Whereas Article 7 of Commission Regulation(EC) No 1445/95 of 26 June 1995 on rules of application for import and export licences in the beef and veal sectorand repealing Regulation(EEC) No 2377/80(3), as last amended by Regulation(EC) No 2469/97(4), provides that all exportation of products must, for an export refund to be claimed, require the issuing of an export licence with advance fixing of the refund;
Whereas it should be stipulated that Commission Regulation(EC)No 1162/95 of 23 May 1995 laying down special detailed rules for the application of the system of import and export licences for cereals and rice(5), as last amended by Regulation(EC) No 932/97(6), applies under this Regulation;
(63) in order to monitor the volume of trade in wine with third countries,provision should be made for a system of import and export licences for certain products, which includes the lodging of a security to guarantee that the transactions for which such licences are granted are effected;
It should therefore follow, to a large extent, the procedure already in place for certain agricultural certificates, which is set out in Commission Regulation(EC)No 1291/2000 of 9 June 2000 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products(5).
(5) Article 7a of Commission Regulation(EC)No 1162/95 of 23 May 1995 laying down special detailed rules for the application of the system of import and export licences for cereals and rice(7), as last amended by Regulation(EC) No 1006/2002(8), provides for special arrangements for exports to Poland and the Baltic States.
