In the light of the Standard Rules on the Equalization of Opportunities for Persons with Disabilities2 and the recommendations that it adopted during its day of general discussion on the rights of children with disabilities, held on 6 October 1997(see CRC/C/69, para. 338), the Committee has recommended the development ofearly identification programmes to prevent disabilities, implement alternative measures to the institutionalization of children with disabilities, and envisage awareness-raising campaigns to reduce discrimination against disabled children and encourage their inclusion into society.
(c) Undertake efforts to establish and implement alternative measures to prevent the institutionalization of children with disabilities, including community-based rehabilitation programmes and home-based care;
(d) Implement alternative measures to deprivation of liberty, such as probation, community service or suspended sentences, in order to ensure that persons below 18 are deprived of liberty only as a last resort and for the shortest appropriate period of time;
It recommended that Mali speedup the process of legal reform, develop and implement alternative measures such as diversion and restorative justice, and ensure that deprivation of liberty is used only as a measure of last resort and for the shortest appropriate period of time.
Governments should develop and implement alternative measures with a variety and a flexibility that allow for an adjustment of themeasure to the individual capacities and abilities of the child in order to avoid the use of judicial proceedings.
CRC also recommended, among other things, that Malawi implement alternative measures to deprivation of liberty, ensure that children in conflict with the law have access to free legal assistance and to an independent and effective complaints mechanism, and provide training on the Convention to all professionals working in the juvenile justice system.
(b) Reduce the rate of overcrowding by implementing alternative measures, in particular for women with children.
The Secretary-General also encourages States totake steps to end immigration detention and implement alternatives measures to detention for irregular migrants, and to review detention periods in order to avoid excessive detention of irregular migrants.
Further encourages all States to ensure that immigrants in an irregular situation and asylum-seekers are protected from arbitrary arrest and detention and to take action to prevent any form of arbitrary deprivation of liberty of immigrants and asylum-seekers,and notes with appreciation that some States have successfully implemented alternative measures to detention for undocumented migrants;
