أولا، وفقا للفقرة 1 من المادة 13 مكررة، من النظام الأساسي للمحكمة الجنائية الدولية بصيغته التي عدلها قرارا مجلس الأمن 1166(1998) المؤرخ 13 أيار/مايو 1998 و 1329(2000)المؤرخ 30 تشرين الثاني/نوفمبر 2000، تنتخب الجمعية العامة القضاة الـ 14 الدائمين في المحكمة الجنائية الدولية من قائمة بالمرشحين يقدمها مجلس الأمنتنتخب الجمعية First, according to article 13, paragraph 2, of the Statute of the International Tribunal,the 11 judges of the International Tribunal shall be elected by the General Assembly from a list of candidates submitted by the Security Council.
أوﻻ: بموجب المــادة ١٣، الفقــرة ٢،من النظام اﻷساسي للمحكمة الدولية تنتخب الجمعية العامة قضاة المحكمة الدولية اﻟ ١١ من قائمــة بالمرشحين يقدمها مجلس اﻷمن(c) The judges shall be elected by the General Assembly from a list submitted by the Security Council(article 13, para. 2);

يستعاض عن الفقرة ٣ بما يلي:" تنتخب القضاة الجمعية العامة لﻷمم المتحدةتنتخب الجمعية العامة ومجلس اﻷمن قضاة المحكمة من قائمة أشخاص ترشحهم مجموعات وطنية من الدول اﻷطراف تعينها حكوماتهم لهذا الغرضArticle 3 of the statute of the InternationalLaw Commission provides that the members of the Commission shall be elected by the General Assembly from a list of candidates nominated by the Governments of States Members of the United Nations.
تنص المادة 3 منالنظام الأساسي للجنة القانون الدولي على أن تنتخب الجمعية العامة أعضاء اللجنة من قائمة مرشحين تسميهم حكومات الدول الأعضاء في الأمم المتحدةتنتخب الجمعية العامة قضاة الآلية من قائمة يقدمها إليها مجلس الأمن، على النحو التاليAccording to article 12, paragraph 3, of the Statute of the International Tribunal for Rwanda,the judges of the Trial Chambers of the International Tribunal for Rwanda shall be elected by the General Assembly from a list of candidates submitted by the Security Council.
