It was also a positive step to recognise the right of any citizen, any natural orlegal person residing in a Member State, to have access to European Parliament, Council and Commission documents.
The intention is that the adoption of this report will extend the scope of Council Directive 2003/109/EC concerning the status of third-country nationals who are long-term residents andbeneficiaries of international protection who have been legally residing in a Member State for a period of more than five years.
This directive is essentially concerned with protecting the rights of someone residing in a Member State, as well as the rights of citizens of that Member State, in keeping with the principle of reciprocity.
The proposed Directive continues to not apply to persons seeking international protection and awaiting decision on their status orto those who are beneficiaries of temporary protection or residing in a Member State on a strictly temporary basis.
It aims to give beneficiaries of international protection who have been legally residing in a Member State for a period of five years legal certainty about their right of residence in a Member State, as well as a set of rights comparable to those of EU nationals.
The Council adopted a directive amending directive 93/109/EC as regards certain detailed arrangements for the exercise of the right to stand as a candidate in elections to the European Parliament for citizens of the Union residing in a member state of which they are not nationals 17198/12.
There are general principles on crossing external frontiers and control arrangements, controls of third country nationals residing in a Member State, a list of persons to whom entry may be refused and guidelines on the issue of residence permits and uniform visas.
Also, very importantly, there is the declaration by the Council and the Parliament on the issue of stateless citizens which states that‘the European Parliament and the Council request the Commission to bring forward proposals, in the framework of the revision of Regulation(EC) No 539/2001, in order toexempt holders of aliens' and non-citizens' passports residing in a Member State from the visa obligation.
It also does not cover third-country nationals who are EC long-term residents or refugees, those residing in a Member State on a strictly temporary basis in accordance with EC legislation or under commitments contained in international agreements, and other limited categories.
By failing to bring into force within the prescribed period the laws, regulations and administrative provisions necessary to comply with Council Directive 94/80/EC of 19 December 1994 laying down detailed arrangements for the exercise of the right to vote andto stand as a candidate in municipal elections by citizens of the Union residing in a Member State of which they are not nationals, the Kingdom of Belgium has failed to fulfil its obligations under the first paragraph of Article 14 of that directive;
The main objective of the proposal was to give beneficiaries of international protection who have been legally residing in a Member State for a period of 5 years legal certainty about their right of residence in a Member State, as well as a set of rights comparable to those of EU nationals.
The Treaty on European Union, in particular Article 8b,does not change this legal situation in that it is limited to granting the right to vote to citizens of the European Union residing in a Member State of which they are not nationals, under the same conditions as nationals of that state. .
I voted in favour of this report as I believe that the extension of long-term resident status to beneficiaries of international protection who have been legally residing in a Member State for a period of five years is quite clearly justifiable, since it guarantees equality of treatment to all nationals of third countries, and promotes the economic and social cohesion of the European Union.
To achieve these objectives the Commission proposes to guarantee a common set of rights to all third-country workers lawfully residing in a Member State and not yet entitled to long-term residence status, and to introduce a single application procedure, along with a single residence/work permit.
