As regards other products, being measures designed to amend non-essential elements of this Directive, in accordance with the regulatory procedure with scrutiny referred to in Article 20(3).".
It introduced the“regulatory procedure withscrutiny” for measures of general scope designed to amend non-essential elements of basic acts.
The measures referred to in paragraphs 1 and 2, designed to amend non-essential elements of this Regulation, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 12(3).”.
Therefore the regulatory procedure with scrutiny should befollowed for measures of general scope which seek to amend non-essential elements of Regulation(EEC) No 3922/91.
By a decision adopted by the Commission; that measure, designed to amend non-essential elements of this Regulation, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 14(3).".

The Directive encodes and adapts the legislation in force(Directive 90/377/EEC) to the new committee procedure with scrutiny intended foruse with measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the codecision procedure.
That measure, designed to amend non-essential elements of this Regulation, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 32(3). CHAPTER II.
Article 17 shall be replaced by the following:‘Article17 The measures necessary for adapting the Annexes to scientific and technical progress, designed to amend non-essential elements of this Directive, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 18(4).';
Those measures, designed to amend non-essential elements of this Regulation, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 52(6).
Before presenting its communication, the Commission had carefully examined all the instruments adopted under the codecision procedure in order to identify those which authorise it to adopt measures of general scope designed to amend non-essential elements of the basic instrument in question.
Any other treatment provided for by the Commission; those measures, designed to amend non-essential elements of this Regulation by supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 33(3).".
The measures designed to amend non-essential elements of this Regulation relating to the adaptation of Annex IIto technical progress shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 14(2).
Pursuant to Article 27,‘the adaptation to technical progress of Sections C and Dof Annex II, Annexes III to VI, and Section C of Annex VII, designed to amend non-essential elements of this Directive, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 30(3)'.
That Regulation, designed to amend non-essential elements of this Directive by supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 28(4).
In the context of the alignment of Regulation(EC) No 1059/2003 to the new rules of the Treaty on the Functioning of the European Union(TFEU),powers currently conferred on the Commission by that regulation to adopt acts designed to amend non-essential elements of the regulation by supplementing it, in accordance with the regulatory procedure with scrutiny, should be provided for by powers to adopt delegated acts.
The measures referred to in points(a),(b) and(e), designed to amend non-essential elements of this Decision, inter alia by supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 7(3).
The specific measures referred to in points(f),(g),(h),(i),(j),(k),(l) and(n),measures designed to amend non-essential elements of this Regulation, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 23(3).
Any measures designed to amend non-essential elements of this regulation, inter alia by supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 11( 3).
The measures referred to in points(a) and(b) of the secondsubparagraph, designed to amend non-essential elements of this Directive by supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 27(2a).
Since those measures are of general scope andare designed to amend non-essential elements of Regulation(EC) No 868/2004 by supplementing it, they must be adopted in accordance with the regulatory procedure with scrutiny provided for in Article 5a of Decision 1999/468/EC.
It introduced the newprocedure for measures of general scope designed to amend non-essential elements of a basic instrument adopted in accordance with the codecision procedure(Article 251 of the EC Treaty).

This procedure should provide for theadoption of measures of general scope designed to amend non-essential elements of the basic act, inter alia by deleting some of those elements or by supplementing the instrument by the addition of new non-essential elements. .
The measures referred to in the first subparagraph, designed to amend non-essential elements of this Directive, including by supplementing it, shall be adopted in accordance with the regulatory procedure with scrutiny referred to in Article 41( 2a).".
