The application referred to in paragraph 1 shall contain.

If an application referred to in paragraph 4 or 5 is submitted within two years from the date of entry into force of this Regulation, the rights acquired under this Regulation shall have effect from that date, and the provisions of the legislation of any Member State concerning the forfeiture or limitation of rights may not be invoked against the persons concerned.
If an application referred to in paragraph 4 or 5 is submitted after the expiry of the two-year period following the entry into force of this Regulation, rights which have not been forfeited or are not barred by limitation shall have effect from the date on which the application was submitted, except where more favourable provisions of the legislation of any Member State apply.
The application referred to in paragraph 1 must contain the following information relating to the instrument or apparatus in question:(a) the precise trade description of the instrument or apparatus used by the manufacturer, its presumed Common Customs Tariff classification and the objective technical characteristics on the basis of which the instrument or apparatus is considered to be scientific;
That application referred to in paragraph 1 shall be accompanied by a description of the conformity assessment activities, the conformity assessment module or modules and the product or products for which that body claims to be competent, as well as by an accreditation certificate, where one exists, issued by a national accreditation body attesting that the conformity assessment body fulfils the requirements laid down in Article 31.
Inventions which are the subject of applications referred to in paragraph 1 may be used only with the consent of the applicant or in accordance with Articles 17 to 23.
The Commission shall decide on the applications referred to in paragraph 2 within 6 weeks from the date of reception of the application and inform the Member State in writing.
The Commission will suspend the application of paragraph 1(b) and2 once it has observed that the applications referred to in paragraph 1(b) have reached 120000 tonnes.
Applications referred to in paragraphs 1 and 3, including'nil' notifications, shall be made in accordance with the model set out in Annex II.
