Authentic instruments.
This Regulation shall apply to judgments,court settlements and authentic instruments on uncontested claims.
Authentic instruments and agreements.
It lays down uniform rules to settle conflicts of jurisdiction and facilitate the free circulation of judgments,court settlements and authentic instruments in the European Union.
Authentic instruments and agreements.
Those documents which have been formally drawn up or registered as authentic instruments and are enforceable in one Member State are treated as equivalent to such"judgments.
Authentic instruments and agreements between parties which are enforceable in a Member State should be treated as equivalent to decisions.
A settlement which has been approved by a court in the course of proceedings andis enforceable in the Member State in which it was concluded shall be enforceable in the State addressed under the same conditions as authentic instruments.

In order to achieve these objectives, this Regulation should group together the provisions on legal jurisdiction, applicable law,recognition and enforcement of decisions and authentic instruments in this area and on the European Certificate of Succession.
It facilitates the free circulation of judgments, authentic instruments and agreements in the Union by laying down provisions on their recognition and enforcement in other Member States.
In order to achieve the desired objectives, this Regulation brings together in one instrument the provisions on legal jurisdiction, applicable law, the recognition andenforcement of decisions and authentic instruments, and reliance on matrimonial property regimes in dealings with third parties.
Authentic instruments and agreements between parties that are enforceable in one Member State should be treated as equivalent to‘judgments' for the purpose of the application of the rules on recognition and enforcement.
Should an authority, in application of this Regulation, be presented with two incompatible authentic instruments, it should assess the question as to which authentic instrument, if any, should be given priority taking into account the circumstances of the particular case.

The Regulation provides for uniform rules to settle conflicts of jurisdiction between Member States andfacilitates the free circulation of judgments, authentic instruments and agreements in the Union by laying down provisions on their recognition and enforcement in another Member State.
Authentic instruments drawn up and enforceable in one Member State shall, on request, be declared enforceable in another Member State following the procedure set out in Articles[38 to 57] of Regulation(EC) No 44/2001.
In order to achieve these objectives, this Regulation brings together in one instrument the provisions on jurisdiction, applicable law, the recognition andenforcement of decisions and authentic instruments, and reliance on the property relationships arising from registered partnerships in dealings with third parties.
Applications for the separation of property, authentic instruments, rulings on the matrimonial property regime and in particular all amendments thereto without prejudice to the future liquidation of the pre-existing community, if applicable.
The objective of both proposals is to establish a framework in the EU determining jurisdiction and the law applicable to matrimonial property regimes and the property consequences of registered partnerships and to facilitate the recognition andenforcement of decisions and authentic instruments among the member states.

It has facilitated the settlement of increasing cross-border litigation in matrimonial and parental responsibility matters through a comprehensive system of jurisdiction rules, an efficient system of cooperation between Member State Central Authorities, the prevention of parallel proceedings andthe free circulation of judgments, authentic instruments and agreements.
Authentic instruments drawn up in a Member State shall be recognised in the other Member States, unless their validity is disputed in accordance with the applicable law, and provided such recognition is not contrary to public policy in the Member State addressed.
Most of the definitions appear in other instruments e.g. authentic instruments are defined in Article 4(3) of Parliament and Council Regulation(EC) No 805/2004 of 21 April 2004 creating a European Enforcement Order for uncontested claims.
Given the practical importance of authentic instruments for matrimonial property regimes and in order to ensure the consistency of this Regulation with other EU instruments, this Regulation must ensure their acceptancefor the purposes of their free circulation.
In order to ensure that the certificates to be used in connection with the recognition orenforcement of decisions, authentic instruments and agreements under this Regulation are kept up to date, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of amendments to Annexes I to III to this Regulation.
