In the Community CTVs are manufactured by the following operators.
Dumping margin for the Turkish company exporting CTVs of Chinese origin.
CTVs are progressively becoming a mature product, where prices are eroded regularly.
Termination of the anti-dumping proceeding concerning CTVs originating in Turkey.
It was found that these CTVs were exported from Turkey at significantly dumped prices.
Furthermore, the company imported a significant quantity of the other materials input to the CTVs production.
No Chinese producer with exports of CTVs to the Community during the review IP cooperated in the investigation.
However, in the course of that investigation all Turkish companies stated that their CTVs were not of Turkish origin.
Exports of Chinese CTVs to Japan increased from around 1,3 million sets in 1996 to around 2,3 million sets in 2000.
Initially, it reported in its claim form and in its questionnaire response certain CTVs exports to the Community.
The table clearly shows that Community demand for CTVs increased during the period considered and in particular in 1997 and 1998.
According to the information available,in particular the review request, large capacities for CTVs production exist in Malaysia.
Investments by the Community industry related to CTVs increased from EUR 48 million in 1995, to EUR 52 million during the IP, i.e. an increase of 10.
Thus, it is considered that the calculation of price undercutting on this basis adequately reflects the price differential between Chinese and Community CTVs.
It is recalled that the Commission terminated the proceeding concerning CTVs originating in Turkey by Decision 2001/725/EC14.
Furthermore, a substantial part of imports of CTVs, including non-branded CTVs, into the Community are not covered by anti-dumping measures and thus the continuation of measures on imports of CTVs originating in the countries concerned would not significantly limit the availability of non-branded CTVs with a limited number of features.
However, according to the information available from Eurostat, CTVs were exported from this country during the review IP.
However, one cooperating Turkish company,Vestel Elektronik Sanayi ve Ticaret AS, was found to be exporting significant quantities of CTVs of Chinese origin.
Therefore, the relocation cannot hide the fact that the demand for CTVs continued to grow in the Community indicating that the product concerned is not obsolete.
It is therefore considered most likely that, should measures be repealed,the dumped exports of Chinese CTVs to the Community will increase significantly.
In fact, since CPTs are used in the production of CTVs, the analysis of Community consumption for CTVs makes the analysis of the Community CPT market more complete.
According to the information available, i.e. Eurostat,the non-cooperating producers did not export CTVs of Thai origin to the Community during the review IP.
It should also be pointed out that in a time when CTVs production was relocated to certain CEECs, the Community industry maintained its CPT production in the Community.
It should be noted that Eurostat figures, which were the only information available,may not reflect the actual origin of CTVs imported into the Community from other third countries.
As the origin of the CPTs is often decisive in determining the origin of the CTVs, the production capacities of CPTs in Malaysia were examined and were also found to be significant.
From the above the conclusion is drawn that the negative development in Community CPT consumption is not the result of a general declining demand for CTVs, since demand increased by around 11% from 1995 up to 1998.
However, at a subsequent stage of the investigation it was found that these CTVs were never released into free circulation in the Community and that their final destination was a third country.
However, this exporting producer was found to have exported to the Community CTVs originating in countries concerned other than Thailand.
It is recalled that the anti-dumping measures have been in force on imports of CTVs originating in Korea since 1990, China since 1991 and Malaysia, Singapore and Thailand since 1995.
It is recalled that the main decrease of Community consumption is attributable to the fact, that in the first part of the period considered,part of the production of 14-inch colour television sets("CTVs") in the Community was transferred to certain central and east European countries(CEECs) see recital 46 of the provisional Regulation.
