Whereas the said Protocol should be approved.
Whereas on 17 May 1980 the Community signed the said Protocol;
The text of the said Protocol and the annexes thereto are attached to this Decision.
Whereas the Community signed the said Protocol on 30 March 1983;
Whereas the ACP States concerned have supported the Ivory Coast's request to accede to the said Protocol;
Whereas the Convention and the said Protocol were signed on behalf of the Community on 13 September 1976.
It is in the Community's interest to approve the said Protocol.
In accordance with Article 1 of the said Protocol, Ireland is not taking part in the adoption of this Directive.
Acting in accordance with the procedure provided for in Article 106(6) of the Treaty and in Article 42 of the said Protocol.
In accordance with Article 1 of the said Protocol, Ireland is not participating in the adoption of this Regulation.

Council Regulation(EC) No 3605/93[4] amended by Council Regulation(EC) No 475/2000[5] and by Commission Regulation(EC) No 351/2002[6] lays down detailed rules anddefinitions for the application of the provision of the said Protocol.
Under Article 1 of the said Protocol and Article 1 of the Agreement between the European Economic Community and the Republic of India on cane sugar, these preferential import arrangements must be implemented within the framework of the common organisation of the market in sugar.
Whereas it is appropriate to approve an Agreement in the form of an exchange of letters between the European Economic Community, the States referred to inthe said Protocol and the Republic of the Ivory Coast on the accession of the Ivory Coast to the said Protocol.
The possibility that an intergovernmental organisation which has a regional office for the purpose of registering marks may become a party to the Madrid Protocol was introduced in the Madrid Protocol in order to allow, in particular,for the European Community to accede to the said Protocol.

Whereas Declaration 2 in the Annex to Protocol 7 on ACP sugar annexed to the Second ACP-EEC Convention(1) provides that Saint Christopher andNevis shall benefit from treatment identical to that provided for in the said Protocol in respect of a quantity of 14 800 tonnes;
Whereas the Community will participate in the implementation of the said Protocol by exercising its competence as resulting from the existing common rules as well as those acquired as a result of future acts adopted by the Council, and by using the results of Community actions(research- exchange of information) in the fields concerned;
The products shall be placed in free circulation on presentation fo an EUR.1 certificate issued by the exporting country in accordance with Protocol 4 to the Europe Agreements concluded with the said countries, or,of a declaration by the exporter in accordance with the provisions of the said Protocol.
Given that this Regulation builds upon the Schengen acquis under the provisions of Title IV of Part Three of the EC Treaty,Denmark shall, in accordance with Article 5 of the said Protocol, decide, within a period of six months after the adoption of this Regulation, whether it will implement it in its national law.
Whereas the Community, in view of its responsibilities for the environment has, by Decision 88/540/EEC(4), become a party to the Vienna Convention for the protection of the ozone layer and the Montreal Protocol on substances that deplete the ozone layer, and by Decision 91/690/EEC(5)has approved the first amendment to the said Protocol;
Since this Instrument aims to build upon the Schengen acquis under the provisions of Title IV of the Treaty establishing the European Community, Denmark shall,in accordance with Article 5 of the said Protocol, decide within a period of six months after the Council has adopted this Decision whether it will transpose it into its national law.
In accordance with Article 1 of the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, Ireland is not participating in the adoption of this Regulation. As a result, andwithout prejudice to Article 4 of the said Protocol, the provisions of this Regulation do not apply to Ireland.
Given that this Decision builds upon the Schengen acquis under the provisions of Title IV of Part Three of the Treaty establishing the European Community, Denmark shall,in accordance with Article 5 of the said Protocol, decide within a period of six months after the Council has adopted this Decision whether it will implement it in its national law.
