The primary energy savings calculated in accordance with Annex II based on the harmonised efficiency reference values indicated in Annex II paragraph(f);
(25) To increase transparency for the final customer to be able to choose between electricity from cogeneration andelectricity produced by other techniques, the origin of high-efficiency cogeneration should be guaranteed on the basis of harmonised efficiency reference values.
Specify the primary energy savings calculated in accordance with Annex III based on harmonised efficiency reference values established by the Commission as referred to in Article 4(1).
On the basis of the harmonised efficiency reference values referred to in Annex II(f), Member States shall ensure that the origin of electricity produced from high-efficiency cogeneration can be guaranteed according to objective, transparent and non-discriminatory criteria laid down by each Member State.
An indispensable element of the guidelines was a Decision adopted in 2006 on harmonised efficiency reference values for separate production of electricity and heat10.
The Commission shall review the harmonised efficiency reference values for separate production of electricity and heat referred to in paragraph 1, for the first time on 21 February 2011, and every four years thereafter, to take account of technological developments and changes in the distribution of energy sources.
The Commission shall be empowered to adopt delegated act in accordance with Article 18 to review the harmonised efficiency reference values referred to in Article 10(10) third indent.
The Commission shall, in accordance with the procedure referred to in Article 14(2), review the harmonised efficiency reference values for separate production of electricity and heat referred to in paragraph 1, for the first time on 21 February 2011, and every four years thereafter, to take account of technological developments and changes in the distribution of energy sources.
For the purpose of determining the efficiency of cogeneration in accordance with Annex III, the Commission shall, in accordance with the procedure referred to in Article 14(2),not later than 21 February 2006, establish harmonised efficiency reference values for separate production of electricity and heat.
In order toensure that the Annexes to the Directive and the harmonised efficiency reference values referred to in Article 14(10) can be updated, it is necessary to extend the delegation of powers granted to the Commission.
(21) To increase transparency for the consumer's choice between electricity from cogeneration and electricity produced on the basis of other techniques,it is necessary to ensure that, on the basis of harmonised efficiency reference values, the origin of high-efficiency cogeneration can be guaranteed.
In accordance with Article 15(4), use and gradually increase the use of harmonised efficiency indicators and benchmarks, both for the evaluation of past measures and estimated effects of planned future measures;-.
(21) To increase transparency for the consumer's choice between electricity from cogeneration and electricity produced on the basis of other techniques,it is necessary to ensure that, on the basis of harmonised efficiency reference values, the origin of high-efficiency cogeneration can be guaranteed.
Some of these barriers have been alreadyaddressed by the Commission, such as the set-up of harmonised efficiency reference values and the adoption of Community detailed guidelines for the calculation of electricity produced from cogeneration, as previously mentioned.
The Member States should take urgent measures to implement the legislation now as all the principal conditions are set by the two Commission Decisions already referred to on harmonised efficiency reference values for separate production of electricity and heat16 and on detailed guidelines for the calculation of the electricity from cogeneration17.
As regards Directive 2004/8/EC,power should in particular be conferred on the Commission to review harmonised efficiency reference values for separate production of electricity and heat, to adapt the threshold values set out in Article 13 to technical progress, and to establish and adapt to technical progress the detailed guidelines for the implementation and application of Annex II of Directive 2004/8/EC, including the determination of the power to heat ratio.
The information collected on the actual energy efficiency values should also be used in reviewing the harmonised efficiency reference values for separate production of heat and electricity set out in Commission Decision 2007/74/EC of 21 December 200631.
The Commission shall be empowered to review,by means of delegated acts in accordance with Article 18, the harmonised efficiency reference values laid down in Commission Decision[the number of the Decision] on the basis of Directive 2004/8/EC for the first time by 1 January 2015, and every ten years thereafter.
For the development of these harmonised energy efficiency indicators and benchmarks the Commission shall use as a reference guide the indicative list set out in Annex V.
Not later than 30 June 2008, the Commission, in accordance with the procedure set out in Article 16(2),shall develop a set of harmonised energy efficiency indicators and benchmarks based upon them, taking into account available data or data that can be collected in a cost-effective manner for each Member State.
As regards Directive 2006/32/EC, power should in particular be conferred on the Commission to adapt certain values and calculation methods to technical progress; to refine and complement the general framework for measurement and verification of energy savings; to raise the percentage of harmonised bottom-up calculations used ina harmonised calculation model; and to develop a set of harmonised energy efficiency indicators and benchmarks.
