In the event that the Committee finds that the State party has violated its obligations under the Convention or its substantive Optional Protocols to which the State is party, it will make recommendations on the remedies for the alleged victim(s), such as, inter alia, rehabilitation, reparation, financial compensation, guarantee of non-repetition, requests to prosecute the perpetrator(s), as well as indicate the time limit for their application.
The member has participated, in any capacity, in the making and adoption of any decision on the communication other than under the procedures applicable to this Protocol,the Convention or the substantive Optional Protocols thereto.
Communications may be submitted by an individual or group of individuals, within the jurisdiction of a State party,claiming to be victim(s) of a violation of the provisions of the Convention and/or the substantive Optional Protocols thereto by this State party, regardless of whether their legal capacity is recognized in the State party against which the communication is directed.
In addition to its complementary nature, the Working Group considered that the preamble should also highlight the purpose of the Optional Protocol to further enhance implementation of the Convention and its two substantive Optional Protocols.
A communication under article 12 of the Protocol may be submitted to the Committee by a State party which claims that another State party is not fulfilling its obligations under the Convention and/or the substantive Optional Protocols thereto, and which has made a declaration in accordance with article 12 of the Protocol.
The Chairperson-Rapporteur wishes to underline the optional nature of the Optional Protocol, as well as the fact that its objective is not to create any new substantive rights;those are stipulated in the Convention on the Rights of the Child and the two existing substantive Optional Protocols to it.
The Committee shall determine whether the information received contains reliable information indicating grave or systematic violations of rights set forth in the Convention or in the substantive Optional Protocols thereto by the State party concerned.
Subject to the provision of rule 45 of the present rules,the Committee shall proceed to make its good offices available to the States parties concerned with a view to reaching a friendly solution to the matter on the basis of respect for the obligations provided for in the Convention and the substantive Optional Protocols thereto.
In accordance with the present rules, the Secretary-General shall bring to the Committee's attention reliable information that is or appears to be submitted for the Committee's consideration under article 13, paragraph 1, of the Protocol, indicating grave orsystematic violations by a State party of any of the rights set forth in the Convention or in the substantive Optional Protocols thereto.
The Committee may terminate its facilitation of the friendly settlement procedure if it concludes that the matter is not susceptible to reaching a resolution or any of the parties does not consent to its application, decides to discontinue it, ordoes not display the requisite will to reach a friendly settlement based on respect for the obligations set forth in the Convention and/or the substantive Optional Protocols thereto.

As a result, the whole of the draft Convention had been adopted with the exception of the optional substantive law priority rules.
On the substantive aspects of the optional protocol, my delegation would like to stress the following points.
The Australian Government has stated on numerous occasions that it has procedural and substantive concerns with the Optional Protocol.
The draft Optional Protocol had both procedural and substantive flaws.
Substantive support to the adoption of the Optional Protocol to the Convention.
Furthermore, since 1958, the codification conventions mostly provided for jurisdiction of the International Court of Justice in the form of optional protocols to the substantive conventions.
It also requested the Secretariat to provide a substantive comparative analysis of the optional protocol to the Convention with existing United Nations treaty-based communications and inquiry mechanisms.
Other delegations favoured a comprehensive approach arguing that an optional protocol should cover all substantive rights contained in the Covenant.
The Division for the Advancement of Women also provided substantive support during the drafting of the Optional Protocol.
The Working Group had previously adopted the title, the preamble and draft articles 1 to 24 of the draft Convention on Assignment in Receivables Financing, andhis delegation hoped that work on the optional substantive law priority rules would be completed expeditiously so that the draft Convention could be submitted to the Commission for adoption in 2000.
They are right in the sense that the substantive issue-- the compulsory or optional nature of Security Council decisions-- is effectively embodied in these two provisions and not in draft article 14.
At its twenty-first session, the Committee on the Elimination of Discrimination against Women requested the Secretariat to provide it with a substantive comparative analysis of the Optional Protocol to the Convention with existing United Nations treaty-based communications and inquiry mechanisms.
In that connection, it had adopted two sets of agreed conclusions which made substantive reference to the Convention, its Optional Protocol and the work of the Committee.
