Insurers and reinsurers must also hold eligible basic own funds to cover the minimum capital requirement.
Basic own funds shall consist of the following items.
Ancillary own funds consist of elements other than basic own funds, which may be called upon to absorb losses.
To hold the eligible basic own funds to cover the absolute floor of the Minimum Capital Requirement provided for in Article 129(1)(d);
Ancillary own funds shall consist of items other than basic own funds which can be called up to absorb losses.
Notwithstanding Article 94,basic own-fund items shall be included in Tier 2 basic own funds for up to 10 years after 1 January 2016, provided that those items.
The Solvency Capital Requirementshall not cover the risk of loss of basic own funds resulting from changes of the volatility adjustment.
Basic own fund items shall be classified in Tier 1 where they possess the characteristics set out in points(1),(2) and(3) of Article 93, and, to a substantial degree, those set out in points(4) and(5) thereof.
Undertakings are therefore required to hold eligible basic own funds to cover the Minimum Capital Requirement(see Article 126).
(4) The eligible amount of basic own funds required to cover the Minimum Capital Requirement and the absolute floor of that Minimum Capital Requirement shall be constituted in accordance with Regulation 112(6).
General provisions Member States shall require that insurance andreinsurance undertakings hold eligible basic own funds, to cover the Minimum Capital Requirement.
(12) By way of derogation from Regulation 114, the Solvency Capital Requirementshall not cover the risk of loss of basic own funds resulting from changes of the volatility adjustment.
The capital requirement for qualifying infrastructure equities referred to in Article 168 of thisRegulation shall be equal to the loss in the basic own funds that would result from the following instantaneous decreases.
The eligible amount of basic own funds to cover the Minimum Capital Requirement set out in Article 126 shall be equal to sum of the amount of Tier 1 and the eligible amount of basic own fund items classified in Tier 2.

To ensure uniform conditions for the calculation of technical provisions and basic own funds by insurance and reinsurance undertakings for the purpose of Directive 2009/138/EC, technical information on relevant risk-free interest rate term structures, fundamental spreads for the calculation of the matching adjustment, and volatility adjustments should be laid down for every reference date.
Insurance and reinsurance undertakings shall use the technical information provided in the Annexes to thisregulation when calculating technical provisions and basic own funds for reporting with reference dates from December 31, 2018 until March 30, 2019.
(c) the linear function referred to in paragraph 2 used to calculate the Minimum CapitalRequirement shall be calibrated to the Value-at-Risk of the basic own funds of an insurance or reinsurance undertaking subject to a confidence level of 85% over a one-year period;
