An indispensable element of the guidelineswas a Decision adopted in 2006 on harmonised efficiency reference values for separate production of electricity and heat10.
The efficiency reference values shall be calculated according to the following principles.
The Commission shall be empowered to adopt delegated act inaccordance with Article 18 to review the harmonised efficiency reference values referred to in Article 10(10) third indent.
Harmonised efficiency reference values for separate production of electricity.
The Commission shall be empowered to adopt delegated acts inaccordance with Article 23 to review the harmonised efficiency reference values referred to in the second subparagraph of Article 14(10).
Those harmonised efficiency reference values are applicable for 10 years from a cogeneration unit's year of construction.
Member States shall apply the correction factors set out in Annex III in order toadapt the harmonised efficiency reference values set out in Annex I to the average climatic situation in each Member State.
The efficiency reference values for separate electricity production and heat production shall reflect the climatic differences between Member States.
In order to make it possible for the Annexes to Directive 2012/27/EU andthe harmonised efficiency reference values to be updated, it is necessary to extend the delegation of powers granted to the Commission.
The efficiency reference values for cogeneration units older than 10 years of age shall be fixed on the reference values of units of 10 years of age.
In order to ensure that the Annexes to the Directive and the harmonised efficiency reference values referred to in Article 14(10) can be updated, it is necessary to extend the delegation of powers granted to the Commission.

(25) To increase transparency for the final customer to be able to choose between electricity from cogeneration and electricity produced by other techniques, the origin of high-efficiency cogenerationshould be guaranteed on the basis of harmonised efficiency reference values.
If the cogeneration unit is operated with more than one kind of fuel,the harmonised efficiency reference values for separate production shall be applied proportionally to the weighted mean of the energy input of the various fuels.
The efficiency reference values for separate production of heat and electricity in accordance with the formula set out in paragraph(b) shall establish the operating efficiency of the separate heat and electricity production that cogeneration is intended to substitute.
Some of these barriers have been already addressed by the Commission,such as the set-up of harmonised efficiency reference values and the adoption of Community detailed guidelines for the calculation of electricity produced from cogeneration, as previously mentioned.
The Commission has reviewed the harmonised efficiency reference values for the separate production of electricity and heat taking into account data from operational use under realistic conditions, provided by Member States and by stakeholders.
The Member States should take urgent measures to implement the legislation now as all the principal conditions are set by the twoCommission Decisions already referred to on harmonised efficiency reference values for separate production of electricity and heat16 and on detailed guidelines for the calculation of the electricity from cogeneration17.
On the basis of the harmonised efficiency reference values referred to in Annex II(f), Member States shall ensure that the origin of electricity produced from high-efficiency cogeneration can be guaranteed according to objective, transparent and non-discriminatory criteria laid down by each Member State.
Pursuant to Article 4(1) of Directive 2004/8/EC of the European Parliament and of the Council(2), the Commission set out in its Implementing Decision 2011/877/EU(3)harmonised efficiency reference values for the separate production of electricity and heat, as a matrix of values differentiated by relevant factors, including year of construction and types of fuel.
Commission Decision of 21 December 2006 establishing harmonised efficiency reference values for separate production of electricity and heat in application of Directive 2004/8/EC of the European Parliament and of the Council(notified under document number C(2006) 6817)( 1).
As regards Directive 2004/8/EC, power should in particularbe conferred on the Commission to review harmonised efficiency reference values for separate production of electricity and heat, to adapt the threshold values set out in Article 13 to technical progress, and to establish and adapt to technical progress the detailed guidelines for the implementation and application of Annex II of Directive 2004/8/EC, including the determination of the power to heat ratio.
