Notification and rectification of unauthorised or incorrectly executed payment transactions.
(2) Where a payment service user denies having authorized an executed payment transaction, the use of a payment instrument recorded by the payment service provider shall in itself not necessarily be sufficient to prove either that the payment transaction was authorized by the payer or that the payer acted fraudulently or failed with intent or gross negligence to fulfill one or more of his obligations under Article 54.
The consumer should receive basic information on executed payment transactions at no additional charge.
In any event, the payer should always be protected by the general refund rulein the case of unauthorised or incorrectly executed payment transactions.
In that case the payer should beprotected by the general rule for a refund when the executed payment transaction exceeds the amount which could reasonably have been expected.
Consumers will be better protected against fraud,possible abuses and payment incidents(e.g. in case of disputed and incorrectly executed payment transactions).
In order to reduce the risks and consequences of unauthorised or incorrectly executed payment transactions, the payment service user should inform the payment service provider as soon as possible about any contestations concerning allegedly unauthorised or incorrectly executed payment transactions, provided that the payment service provider has fulfilled its information obligations under this Directive.

It should be noted that the payment service provider is also liable for refunding losses from fees charged to the user,and interest to which the payer is entitled in connection with the incorrectly executed payment transaction.
However, it should be possible for the payment service provider and the payment service user to agree in theframework contract on the manner in which subsequent information on executed payment transactions is to be given, for instance, that in internet banking, all information on the payment account be made available online.
In order to reduce the risks and consequences of unauthorised or incorrectly executed payment transactions, the payment service user should inform the payment service provider as soon as possible about any contestations concerning allegedly unauthorised or incorrectly executed payment transactions, provided that the payment service provider has fulfilled its information obligations under this Directive.
The deadline and its point of departure are different in Directive 2007/64/ EC which provides thatnotification of an unauthorised or incorrectly executed payment transaction must be made no later than 13 months after the debit date9.
Under the law, the payer's payment service provider is required(if liable for an incorrectly executed payment transaction)to refund the amount of the incorrectly executed payment transaction to the payer without delay(or to restore the balance in the payment account as if the erroneous payment had not been executed if the payment transaction was debited against the payer's payment account).
In connection with the provision of this information to the payment service user on paper, the aforementioned law stipulates that a payment service user who is a consumer may request the payment service provider to send information on individual executed payment transactions on paper once a month free-of-charge.
Where a payment service user denies having authorised an executed payment transaction, the use of a payment instrument recorded by the payment service provider, including the payment initiation service provider as appropriate, shall in itself not necessarily be sufficient to prove either that the payment transaction was authorised by the payer or that the payer acted fraudulently or failed with intent or gross negligence to fulfil one or more of the obligations under Article 69.
