Takes the view that, in the context of regionalisation, decisions on minimum conservation reference sizes for each species should be based on scientific advice;

The minimum conservation reference sizes of marine species specified in Part A of Annexes V to X to this Regulation shall apply for the purpose of:.
Specifications of target species, mesh sizes and minimum conservation reference sizes laid down in Annexes II, III and IV to, and referred to in Articles 3 and 4 and Article 14(1) of, this Regulation;
Minimum conservation reference sizes will be established for all of these fish stocks, the sale of which will be restricted for reduction to fish meal or pet food only.
By way of derogation from Article 15 of Regulation(EU) No 1380/2013, the minimum conservation reference sizes of sardine, anchovy, herring, horse mackerel and mackerel shall not apply within a limit of 10% by live weight of the total catches retained on board of each of those species.

Whereas, for the same species, minimum conservation reference sizes may vary from one area to another in order to take into account the specific nature of the species and fisheries;
They include baseline mesh sizes, minimum conservation reference sizes, closed or restricted areas to protect juveniles and spawning fish and any other regionally specific measures.
(20) In accordance with Regulation(EU) No 1380/2013, minimum conservation reference sizes should be established to ensure the protection of juveniles of marine species and for the purpose of establishing fish stock recovery areas, as well as for the purpose of constituting minimum marketing sizes. .
They should consist of baseline mesh sizes for towed gears andstatic nets, minimum conservation reference sizes, closed or restricted areas, nature conservation measures to mitigate against bycatches of marine mammals and seabirds in certain areas and any other regionally specific measures currently in existence that are still required to ensure conservation objectives continue to be met until such times measures are put in place under regionalisation.
