Decisions on appeals and disciplinary cases that are fair and conform to the Organization's policies and rules.
In considering the implementation of the request to transfer responsibility for formulating decisions on appeals, the following factors were taken into account.
The decisions on appeals taken by the Identification Commission shall be communicated individually and in writing to the persons concerned.
Ii The United Nations Appeals Tribunal issues final and binding decisions on appeals made to it within one year of receipt.
One suggested measure was to transfer to the Office of the Secretary-General orother Secretariat units the responsibility for formulating decisions on appeals.

Those issues included the following:(a)time limits;(b) the appearance of conflict of interest in formulating decisions on appeals;(c) training of all staff involved in the system of administration of justice;(d) increasing staff participation in the Joint Appeals Board("jury system"); and(e) the financial liability of managers.
Also decides that measures should be taken to eliminate the appearanceof conflict of interest, and towards this end requests the Secretary-General to proceed with the transfer of the responsibility for formulating decisions on appeals from the Department of Management of the Secretariat to the Office of the Secretary-General;
Concerning the OIOS recommendation to transfer responsibility for preparing decisions on appeals outside the Department of Management, the Secretary-General notes that, aside from the Office of the Secretary-General, the only possible other Secretariat unit to which the function could be transferred would be the Office of Legal Affairs.
In paragraph 17 of the same resolution, the Assembly decided that measures should be taken to eliminate the appearanceof conflict of interest, and towards that end requested the Secretary-General to proceed with the transfer of the responsibility for formulating decisions on appeals from the Department of Management to the Office of the Secretary-General.
Recalling that the General Assembly, in paragraph 17 of its resolution 59/283, had requested the Secretary-General to transfer responsibility for formulating decisions on appeals from the Department of Management to the Office of the Secretary-General, the Advisory Committee recommended that the unit should be placed elsewhere in the Organization, for example, in the Executive Office of the Secretary-General.
In paragraph 17 of its resolution 59/283, the General Assembly decided that measures should be taken to eliminate the appearance ofconflict of interest and to this end requested the Secretary-General to proceed with the transfer of the responsibility for formulating decisions on appeals from the Department of Management of the Secretariat to the Office of the Secretary-General.
With respect to the responsibility for formulating decisions on appeals, the Committee recalls paragraph 17 of General Assembly resolution 59/283 in which the Assembly decided that measures should be taken to eliminate the appearance of conflict of interest, and towards this end requests the Secretary-General to proceed with the transfer of the responsibility for formulating decisions on appeals from the Department of Management of the Secretariat to the Office of the Secretary-General.
In addition, over 100 appeal and performance management cases are reviewed andfollow-up action to implement decisions on appeals and disciplinary cases is monitored to ensure consistent application of decisions. .
In this connection, the Committee recalls paragraph 17 of General Assembly resolution 59/283 in which the Assembly called for measures that should be taken to eliminate the appearanceof conflict of interest, and towards that end requested the Secretary-General to proceed with the transfer of responsibility for formulating decisions on appeals from the Department of Management to the Office of the Secretary-General.
The decrease includes the outward transfer of one P-5 post from this section to section 1, Overall policymaking, direction and coordination to implement paragraph17 of resolution 59/283, in which the General Assembly requested the transfer of responsibility for formulating decisions on appeals from the Department of Management to the Office of the Secretary-General. This reduction is partially offset by delayed impact provisions related to a new P-5 post approved in the biennium 2006-2007 for the presiding officer of the Joint Appeals Board.
With regard to the administration of justice in operative paragraph 17 of resolution 59/283, the General Assembly decided that measures should be taken to eliminate the appearance ofconflict of interest and, to that end, requested the Secretary-General to proceed with the transfer of responsibility for formulating decisions on appeals from the Department of Management of the Secretariat to the Executive Office of the Secretary-General.
VIII.6 The Advisory Committee notes that one P-5 post has been transferred to section 1, Overall policymaking, direction andcoordination, in order to implement the General Assembly's decision, contained in paragraph 17 of its resolution 59/283, that responsibility for formulating decisions on appeals be transferred from the Department of Management to the Office of the Secretary-General in order to eliminate the appearance of conflict of interest A/62/6(Sect. 28A), para.
In its resolution 59/283, the General Assembly decided that measures should be taken to eliminate the appearance of aconflict of interest and, to that end, requested the Secretary-General to proceed with the transfer of responsibility for formulating decisions on appeals from the Office of the Under-Secretary-General for Management to the Executive Office of the Secretary-General.
