We welcome the fact that the United Nations has long been involved in the question of the elimination of all forms of intolerance and discrimination based on religion or belief.
The Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief was adopted by the General Assembly in its resolution 36/55 on 25 November 1981.
The question of religion and belief had been addressed more specifically in the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief.
Interim reports on the elimination of all forms of intolerance and discrimination based on religion or belief, submitted to the General Assembly(Third Committee) eight reports since 1994.
At the fifty-third session, on 24 March 1997, on agenda item 19:Implementation of the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief;
Underlining the importance of the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief, proclaimed by the General Assembly in its resolution 36/55 of 25 November 1981.
For this reason, the Special Rapporteur this year formulated a plan to finalize this activity by November 2001,the anniversary of the adoption of the Declaration on the Elimination of All Forms of Intolerance and Discrimination based on Religion or Belief.
Decides to remain seized of the question of the elimination of all forms of intolerance and discrimination based on religion or belief under the same agenda item.
The Commission had therefore encouraged the Special Rapporteur to continue to examine incidents and governmental actions in all parts of the world that were incompatible with the provisions of the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief, adopted in 1981.
To implement the provisions of the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief adopted by the General Assembly on 25 November 1981;
He again reminds the Iranian authorities of the need to ensure respect for the relevant provisions of international law, including article 18 of the International Covenant on Civil and Political Rights and the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief.
Articles 2, 3 and 8 of the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief, adopted by the General Assembly on 25 November 1981, provide as follows.
It is envisaged this work will contribute toward the goals of the UN's 1981'Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief.
Those Committees have in the past studied(see,inter alia,“Study Series 2: Elimination of all forms of intolerance and discrimination based on religion or belief”, Study by the Special Rapporteur, Ms. Odio Benito), and continue to study, questions relating to intolerance and discrimination based on religion or belief in the course of their treaty-monitoring activities.
The number and seriousness of mandate-related allegations received by the Special Rapporteur lead to the conclusion that the protection of freedom of religion or belief and the implementation of the 1981 Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief is far from being a reality.
Both article 18 of the International Covenant on Civil and Political Rights and the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief of 25 November 1981 made a distinction between freedom of religion and freedom to manifest one's religion.
The two organizations jointly identified a lack of appropriate, culturally sensitive, and easy-to-use'teaching tools' for unrolling to grassroots communitiesan awareness of the existence and purpose of the U.N. 's benchmark 1981 document,'Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief.
Ms. Mårtensson(Sweden), speaking on behalf of the European Union, said that the draft resolution on the elimination of all forms of intolerance and discrimination based on religionand belief which the European Union would introduce drew on the report of the Special Rapporteur.
Mentioning the major trends observed vis-à-vis discrimination, particularly restrictions on freedom of religion or belief, she noted that women and certain other categories of persons designated as"vulnerable" by the General Assembly in its resolution 63/181 on the elimination of all forms of intolerance and discrimination based on religion or belief were those most affected.
In 1993, IARF also published for use by its member groups around the world a poster-size copy of the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief, which was proclaimed by the General Assembly in its resolution 36/55 of 25 November 1981.
Article 2 specifically enumerates the various aspects of religious freedom, in conformity with the provisions of article 12, paragraph 1, of the American Convention on Human Rights, and article 18, paragraph 1, of the International Covenant on Civil and Political Rights, both of which are in force in the country,as well as the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief.
Although the international provisions are worded a little differently, they all have the same objective, namely, that'everyone has the right to leave one religion or belief and to adopt another orto remain without any at all'. Likewise, the Commission, in its resolution 2000/33 of 20 April 2000, on the Implementation of the Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief, notes with alarm that serious instances of intolerance and discrimination on the grounds of religion or belief, including acts of violence, intimidation and coercion motivated by religious intolerance, occur in many parts of the world and threaten the enjoyment of human rights and fundamental freedoms.
