The case of Jean Uwinkindi has been referred to Rwanda and is pending appeal.
The Rwandan High Court has also scheduled the trial of Jean Uwinkindi to start on 18 November 2013.
The suspect, Mr. Jean Uwinkindi, was being held at the Kigali prison and would appear before a Rwandan court in August 2012.
A Chamber, composed of Judges Arrey, presiding, Short and Fremr,rendered its decision on 29 June 2011, referring the case against Jean Uwinkindi to the courts of Rwanda.
Two individuals accused by the International Criminal Tribunal for Rwanda, Jean Uwinkindi and Bernard Munyagishari, were transferred to Kigali on 19 April 2012 and 24 July 2013, respectively, following the referral of their cases to Rwanda.
During the reporting period, the Pre-Trial Chamber, composed of Judges Byron, presiding, Kam and Joensen,began its work in the case against Jean Uwinkindi, and rendered five decisions.
The case of Jean Uwinkindi, who has been physically transferred from Arusha to Rwanda, has begun in Kigali before the Rwanda High Court and the Prosecutor has appointed a monitor under the rules to monitor the case.
Further to the above-mentioned transfers, the Prosecutor has appointed a monitor for the case of Jean Uwinkindi, who is currently on trial before the High Court in Rwanda.
One request for referral of a case to Rwanda under rule 11 bis of the rules of procedure andevidence has been approved and is currently pending appeal Jean Uwinkindi.
The Prosecutor has filed three applications for the referral of the cases of one detainee, Jean Uwinkindi, and two fugitives, Charles Sikubwabo and Fulgence Kayishema, to Rwanda for trial.
On 19 April 2012, Jean Uwinkindi became the first accused in the custody of the Tribunal to have been transferred to Rwanda for trial under rule 11 bis of the Rules of Procedure and Evidence after the Appeals Chamber confirmed the referral of the case on 16 December 2011.
Urges the Mechanism to continue monitoring cases of Laurent Bucyibaruta,Wenceslas Munyeshyaka, Jean Uwinkindi and Bernard Munyagishari, which were referred to national jurisdictions;
In the Uwinkindi and Munyagishari cases, which have been transferred to Rwanda for prosecution, the President dismissed without prejudice requests for revocation on 12 and 13 March 2014, respectively. On 28 March 2014,the President dismissed as moot a related motion from Jean Uwinkindi.
Of the accused involved in cases of the International Criminal Tribunal for Rwanda that have been referred to Rwanda, two-- Jean Uwinkindi and Bernard Munyagishari-- have been apprehended and transferred to Kigali.
During the reporting period, commencement of the trial of Jean Uwinkindi in Rwanda was delayed owing to preliminary objections from the defence against the indictment and a proposed system for the payment of defence legal aid.
A Referral Bench composed of Judges Arrey, presiding, Short and Fremr, granted the Prosecutor's application for referral of the case against Jean Uwinkindi to the courts of Rwanda on 28 June 2011.
On 4 November 2010, the Prosecutor filed separate requests for the referral of the cases of Jean Uwinkindi, who was already in the Tribunal's custody, and Charles Sikubwabo and Fulgence Kayishema, both of whom remain at large, to the courts of the Republic of Rwanda.
In addition, renewed efforts in securing the referral of cases to Rwanda, pursuant to Rule 11 bis, resulted in an order for the referral of the case of Jean Uwinkindi by the Trial Chamber in June 2011.
The arrest of fugitives such as Ndahimana andNizeyimana in the second half of 2009 and Jean Uwinkindi in June 2010, translation delays and the occasional unavailability of judges because of their simultaneous sitting on multiple trials caused significant delays in the trial process.
A small increase of temporary staff in theunit is expected to reduce its increased burden. One fugitive indictee, Pastor Jean Uwinkindi, was arrested in Uganda on 30 June 2010.
Jean Uwinkindi, a former pastor in charge of the Pentecostal Church at Nyamata, Kenzenze commune, Kigali Rural préfecture, was arrested on 30 June 2010 in Uganda and transferred to the Tribunal's detention facility on 2 July 2010. On 9 July 2010, he came before Judge Byron for an initial appearance, where he pleaded not guilty to all counts in the indictment.

During the reporting period,the Pre-Trial Chamber in the case of Jean Uwinkindi, composed of Judges Byron, presiding, Kam and Joensen, continued to work on pretrial matters. On 23 November 2010, the Chamber granted the Prosecution's request for leave to amend the indictment. On 1 December 2010, Uwinkindi had his further appearance before Judge Kam and pleaded not guilty to both counts in the amended indictment.
In addition, during the reporting period,the Division continued to respond to various post-referral filings by Bernard Munyagishari and Jean Uwinkindi, seeking revocation or reconsideration of the referral of their cases to Rwanda for trial.
Noting the referral of cases of Laurent Bucyibaruta,Wenceslas Munyeshyaka, Jean Uwinkindi and Bernard Munyagishari to national jurisdictions, pursuant to Rule 11 bis of the Rules of Procedure and Evidence of the International Tribunal, and emphasizing the importance of continuing monitoring progress in referred cases, as well as the goal of achieving the completion of all ICTR and referred cases at the earliest possible time.
During the biennium,the referral chambers allowed the Prosecutor's applications pursuant to rule 11 bis for the referral of the following eight cases to Rwanda for trial: Jean Uwinkindi, Charles Sikubwabo, Fulgence Kayishema, Ladislas Ntaganzwa, Aloys Ndimbati, Charles Ryandikayo, Phénéas Munyarugarama, and Bernard Munyagishari.
During the reporting period, the Appeals Chamber of the International Criminal Tribunal for Rwanda delivered five judgements, in the Théoneste Bagosora and Anatole Nsengiyumva v. The Prosecutor, Aloys Ntabakuze v. The Prosecutor, Dominique Ntawukulilyayo v. The Prosecutor, Ildephonse Hategekimana v. The Prosecutor, and Gaspard Kanyarukiga v. The Prosecutor cases, and, inter alia,a decision upholding a Trial Chamber decision transferring Jean Uwinkindi to Rwanda for trial under rule 11 bis.
The applications by the Prosecutor for transfer of cases to Rwanda under rule 11 bis have succeeded with respect to two indictees in custody(Jean Uwinkindi and Bernard Munyagishari) and six fugitives Fulgence Kayishema, Charles Sikubwabo, Ladislas Ntaganzwa, Charles Ryandikayo, Aloys Ndimbati and Phénéas Munyarugarama.
All applications by the Prosecutor for transfer of the cases of two indictees in custody and six fugitives(detainees Jean Uwinkindi and Bernard Munyagishari and the fugitives Fulgence Kayishema, Charles Sikubwabo, Ladislas Ntaganzwa, Charles Ryandikayo, Aloys Ndimbati and Phénéas Munyarugarama) to Rwanda under rule 11 bis have now been granted, leaving the cases of the three top-level fugitives(Félicien Kabuga, Protais Mpiranya and Augustin Bizimana) earmarked for trial before the International Residual Mechanism for Criminal Tribunals.
As noted in the previous report of the Office of the Prosecutor,eight cases have now been referred, pursuant to rule 11 bis, to Rwanda for trial(Jean Uwinkindi, Charles Sikubwabo, Fulgence Kayishema, Ladislas Ntaganzwa, Aloys Ndimbati, Charles Ryandikayo, Phénéas Munyarugarama and Bernard Munyagishari) and two cases(Laurent Bucyibaruta and Wenceslas Munyeshyaka) have been referred to France.
