Mr. Kolby(Norway): First of all,I would like to thank Judge Pillay for her report.
Judge Pillay easily exceeds the criteria for appointment to that post, as set out in resolution 48/141.
The members of the Council heard informative briefings by Judge Jorda, Judge Pillay and Prosecutor Del Ponte.
The Group congratulates Judge Pillay and welcomes her appointment to that important post within the United Nations system.
We note that agreement hasbeen reached between the Government of Rwanda and the Tribunal on the modalities for cooperation, and that Judge Pillay and her colleagues have been able recently to visit the country.
Judge Pillay brings to that post wisdom and experience gained in over four decades in the area of law and human rights.

It is indeed fitting that at a time when the Tribunal istraversing hitherto unchartered waters, it should be headed by Judge Pillay, whose work and tireless efforts in international humanitarian law have earned her the Noel Foundation award, whose past recipients include Mother Teresa, Ms. Helen Suzman and Ms. Adelaide Tambo.
Judge Pillay brings personal experience, knowledge and the courage to fight for the promotion and protection of all human rights, including the right to development.
From her early work in South Africa, where she represented many opponents of apartheid, to her more recent work as a judge on the International Criminal Tribunal for Rwanda and,later, the International Criminal Court, Judge Pillay has demonstrated a deep commitment to upholding the principles enshrined in the United Nations Charter and the Universal Declaration of Human Rights.
In the Rwanda Tribunal, Judge Pillay sentenced to life imprisonment Mr. Jean-Paul Akayesu, who was convicted of genocide, crimes against humanity and rape.
By its resolution 1482(2003), the Security Council decided that Judge Dolenc and Judge Ostrovsky, who had been replaced as members of the Tribunal, should finish the Cyangugu case, which had begun before their terms of office expired,before the end of February 2004, and that Judge Maqutu and Judge Pillay, also replaced as members of the Tribunal, should finish the Kajelijeli, Kamuhanda and Media cases before the end of December 2003.
From 27 to 30 November 1995, Judge Pillay, in Chambers at the headquarters of the Tribunal, reviewed the first indictment which the Prosecutor had submitted to the Registrar on 22 November 1995.
In response to the Tribunal's request, the Security Council in its resolution 1482(2003), decided that Judge Dolenc and Judge Ostrovsky, who had been replaced as members of the Tribunal, finish the Cyangugu case, which had begun before their terms of office expired,before the end of February 2004, and Judge Maqutu and Judge Pillay, also replaced as members of the Tribunal, finish the Kajelijeli, Kamuhanda and Media cases before the end of December 2003.
We commend the Tribunal and its President, Judge Pillay; the other judges; the Registrar; the Prosecutor; and the staff for their commitment and dedication to the work of the Tribunal.
Judge Pillay also observes that in neither of these two situations could the United Nations fulfil its legal obligations simply by paying a sum of money as compensation to the individual concerned.
In conclusion, I wish to take this opportunity to congratulate Judge Pillay on her appointment to this high post and once again to reiterate our appreciation to the Secretary-General for his judgement and right choice in nominating her as High Commissioner for Human Rights.
Judge Pillay observes that, in the first and third situations, the United Nations is required, under generally accepted human rights norms, to compensate the individual who has been unlawfully convicted, arrested or detained.
In this connection, the members of the Security Council would appreciate from Judge Pillay confirmation that it would indeed be necessary to begin again the Butare case, and if so, the financial and practical consequences of the transfer of the Butare case to a differently constituted Trial Chamber, including the implications for the Tribunal's completion strategy.
Judge Pillay was responsible for one of the landmark rulings against the apartheid system, in which Robben Island prisoners were allowed visits from their lawyers and families, thereby exposing the inhuman conditions for those held in apartheid jails.
It is therefore fitting to appoint Judge Pillay to this supreme and challenging post, as her commitment to the defence and promotion of human rights and her integrity and personality are well recognized internationally.
We thank Judge Pillay for her introduction of the Tribunal's report and congratulate her most heartily on this prestigious award by the United Nations Development Fund for Women(UNIFEM) and the Noel Foundation.
