There is no requirement for either a minimum or a maximum number of suppliers or contractors parties to a framework agreement.

As regards paragraph(c),it was queried whether there should be a limit on the maximum number of suppliers that should be parties to a Type 3 framework agreement.
The procuring entity may impose a maximum number of suppliers or contractors that can be registered for the electronic reverse auction only to the extent that capacity limitations in its communication system so require.

Paragraph(5)(g) is applicable in situations when the procuring entity, in the light of the circumstances of the given procurement, decides that a minimum and/or maximum number of suppliers or contractors with whom to engage in dialogue should be established.
A suggestion was made that determining the maximum number of suppliers with which the procuring entity would negotiate should be left to the procuring entity.
A statement that suppliers or contractors may[apply to become parties] to the framework agreement at any time during the period of its operation,subject to the maximum number of suppliers or contractors, if any.
Thus, it was asserted,there should be no maximum number of suppliers, also so as to encourage as many suppliers to participate.
The 2011 text introduced the possibility of(a) holding a pre-selection procedure for the purpose of limiting the number of suppliers or contractors from which to request proposals and(b)establishing a maximum number of suppliers or contractors that can be invited to participate in the dialogue.
Paragraph(2) dealing with the imposition of a maximum number of suppliers or contractors that can be registered for the auction has been discussed above in connection with paragraph(1)(k)of the article.
The point was made that the idea reflected in paragraphs(3)(a) and(6)(c),of a possible maximum number of pre-selected suppliers and a possible maximum number of suppliers to be invited to a dialogue, should be retained.
Paragraph(2) dealing with the imposition of a maximum number of suppliers or contractors that can be registered for the auction has been discussed in connection with paragraph(1)(k)of the article see paragraph 8 above.
The responsive submissions are then evaluated, applying the evaluation criteria disclosed in the solicitation documents, andsubject to any applicable minimum or maximum number of suppliers or contractors parties as set in the solicitation documents.
As regards paragraph(4),it was queried whether an open framework agreement with a maximum number of suppliers would in effect be a closed rather than an open framework agreement, particularly if the maximum were attained at the initial offer stage.
Iv An explicit statement that suppliers or contractors may apply to become parties to the framework agreement at any time during the period of its operation by presenting indicative submissions,subject to any maximum number of suppliers, if any, and any declaration made pursuant to article 8 of this Law;
It is recommended that the maximum number of suppliers or contractors from which proposals will be requested should be higher than the maximum to be admitted to the dialogue stage, in order to allow the procuring entity to select from a bigger pool the most suitable candidates for the dialogue stage.
Paragraph(3)(e)(ii) is an optional provision(accordingly presented in brackets)permitting a maximum number of suppliers or contractors parties to the framework agreement to be set.
Subject to any maximum number of suppliers or contractors to be parties to the open framework agreement, and the criteria and procedure for the selection of that number, in each case as specified when first soliciting participation in the procurement involving the framework agreement, the framework agreement shall be concluded with all suppliers or contractors satisfying the selection criteria and whose submissions comply with the specifications and any other additional requirements pertaining to the framework agreement.
In the context of a multi-supplier closed framework agreement,the procurement regulations must guide the procuring entity on whether setting either a minimum or a maximum number of suppliers or contractors parties to a framework agreement or both would be appropriate and, if so, what to consider in doing so.
It was observed that the procuring entity also should be given the flexibility to reduce the maximum number of suppliers during the operation of the framework agreement if the procuring entity determined that a reduction would be necessary, and that a discussion to such effect should be included in the Guide.
The requirement for at least three suppliers or contractors if possible has been retained in the 2011 Model Law in the context of the possible minimum and maximum number of suppliers or contractors to be invited to the dialogue phase see paragraphs(5)(g) and(7) of article 49 of the 2011 Model Law**hyperlink.
The procurement regulations should recommend the minimum three suppliers orcontractors with whom to hold the dialogue and where the maximum number of suppliers or contractors from which proposals will be requested is established, that maximum number should be higher than the maximum to be admitted to the dialogue stage, in order to allow the procuring entity to select from a bigger pool the most suitable candidates for the dialogue stage.
If the procuring entity decides to regulate the number of suppliers or contractors to be admitted to the dialogue(see paragraph(5)(g)of the article), the maximum number of suppliers or contractors from which proposals will be requested should be established taking into account the minimum and maximum numbers of suppliers or contractors intended to be admitted to the dialogue stage as will be specified in the request for proposals under paragraph(5)(g) of this article.
Paragraph(7) therefore permits such a maximum number of supplier or contractors parties only where technical capacity constrains access to the systems concerned e.g. the software for the framework agreement may accommodate only a certain maximum number. .
Ii If any maximum limit on the number of suppliers or contractors that are parties to the open framework agreement is imposed in accordance with paragraph 7 of this article, the relevant number and the criteria and procedure, in conformity with paragraph 7 of this article, that will be followed in selecting it;
If any limit on the number of suppliers or contractors that can be registered for the auction is imposed in accordance with paragraph 2 of this article, the relevant maximum number and the criteria and procedure, in conformity with paragraph 2 of this article, that will be followed in selecting it;
Ii If any limitation on the number of suppliers or contractors that are parties to the open framework agreement is imposed in accordance with paragraph(7) of this article, the relevant maximum number and the criteria and procedure, in conformity with this Law, that will be followed in selecting it;
Where the limitation on the number of suppliers or contractors that can be invited to participate in the dialogue was established and the number of responsive proposals exceeds that maximum, the procuring entity shall select the maximum number of responsive proposals in accordance with the criteria and procedure specified in the request for proposals;
