To fill such an information gap, attention was drawn to the working paper on the accountability of international personnel taking part in peace support operations E/CN.4/Sub.2/2005/42.
The sessional working group held discussions on the subjects of the accountability of international personnel taking part in peace support operations; the right to an effective remedy for human rights violations; amnesties, impunity and accountability for violations of international humanitarian law and human rights law; the circumstances in which a party can open fire in international humanitarian law and human rights law; and transitional justice.
Ms. Hampson presented her expanded working paper on the accountability of international personnel taking part in peace support operations(A/HRC/Sub.1/58/CRP.3);
Decides to appoint Françoise Hampson as Special Rapporteur with the task of preparing a comprehensive study on the accountability of international personnel taking part in peace support operations based on her working paper as well as the comments received and the discussions that took place at the fifty-seventh session of the Sub-Commission, and requests the Special Rapporteur to submit a preliminary report to the Sub-Commission at its fifty-eighth session, a progress report at its fifty-ninth session and a final report at its sixtieth session;

In its decision 2001/105, the Sub-Commission, recalling its resolution 2000/24 and Commission on Human Rights resolution 2000/68 and taking note of Commission resolution 2001/70 and the background information provided in document E/CN.4/Sub.2/2001/WP.1, decided to entrust Ms. Françoise Hampson with the task of preparing a working paper on the scope of the activities and the accountability of armed forces, United Nations civilian police, international civil servants and experts taking part in peace support operations.
OHCHR continues its work in the area of the administration of justice, including the administration of justice through military tribunals;the accountability of international personnel taking part in peace support operations; women and children in prison; and the right to a remedy for violations of human rights.
The Sub-Commission adopted decision 2001/105 expressing concern"at the allegations of serious violations of human rights on the part of personnel serving in peace support operations", and entrusted"Françoise Hampson[member from the United Kingdom] with the task of preparing, without financial implications, a working paper on the scope of the activities and the accountability of armed forces, United Nations civilian police, international civil servants andexperts taking part in peace support operations, for submission to the SubCommission at its fifty-fourth session.
Discussions with the International Law Commission focused on the latest report of the Special Rapporteur of the Commission on reservations to treaties(Mr. Pellet),the working paper on accountability of international personnel taking part in peace support operations(Ms. Hampson) and the report on the universal implementation of international human rights treaties Mr. Decaux.
The work currently being conducted by the Sub-Commission pursuant to the study by Ms. Françoise Hampson on the scope of the activities and accountability of armed forces, United Nations civilian police, international civil servants andexperts taking part in peace support operations will undoubtedly contribute to the definition of these terms.
