Procedural gaps.
The Working Group identified and/or considered the following substantive and procedural gaps.
It represented a unique opportunity to fill procedural gaps in existing mechanisms.
The importance of strengthening treaty bodies was noted andit appreciated the proposals put forward by the Committee on the Elimination of Racial Discrimination to address procedural gaps.
Regarding the Committee's recommendations to address procedural gaps, the member summarized the list of recommendations and proposals as follows.
The lack of certain procedures was considered by the Committee to constitute the procedural gaps in the Convention.
For the procedural gaps: the Working Group requested CERD to conduct a further study on possible measures to strengthen the implementation through additional recommendations or the update of its monitoring procedures;
In his opinion, the members of the Committee were not absolutely against the introduction of a new definition; but rather,considered that the focus should be on procedural gaps to strengthen their work.
Regarding procedural gaps, the Working Group recommends that the Committee on the Elimination of Racial Discrimination conduct a further study on possible measures to strengthen implementation through the update of its monitoring procedures.
In the same resolution, the Council requested OHCHR to send out a questionnaire to gather information regarding the three topics discussed during the fourth session of the Ad Hoc Committee and in its report xenophobia,national mechanisms and procedural gaps.
The delegate noted that reference to the obligation of States Parties to establish national mechanisms could be included in any work addressing the procedural gaps in the International Convention on the Elimination of All Forms of Racial Discrimination.
Regarding procedural gaps, the Intergovernmental Working Group recommended that the Committee on the Elimination of Racial Discrimination conduct a further study on possible measures to strengthen implementation through the update of its monitoring procedures.
At the 13th meeting, on 18 April, Alexey Avtonomov, Chairperson of the Committee on the Elimination of Racial Discrimination,gave a presentation titled"Procedural gaps preventing full and adequate implementation of ICERD.
It reiterated its request that topic 7"Procedural gaps with regard to the International Convention on the Elimination of All Forms of Racial Discrimination" be placed on the agenda of the fourth session of the Ad Hoc Committee and again highlighted the importance of the input of experts.
The delegate of Switzerland(on behalf of Argentina, Brazil, Chile, Japan, Mexico, Republic of Korea and Uruguay) underscored the continued relevance of the Convention and its monitoring procedures,adding that Mr. Avtonomov had demonstrated the concrete impact of addressing its procedural gaps.
Made an assessment of the status of SoE reporting in the target countries and identified issues hindering preparation of SoEreports of high quality, among them budgetary challenges, procedural gaps in data flows and validation and experience in concise but informative writing for the report.
Procedural gaps: the need for CERD to be able to undertake country visits; need to formalize the procedure of follow-up to the recommendations addressed to State parties by CERD in its concluding observations as well as in opinions on communications under article 14 of the Convention.
Develop exchanges and recommendations as to national legislative andjudicial measures relating to counterterrorism in order to bridge the legal and procedural gaps preventing the proper prevention, arrest and detention, and punishment of terrorists for their crimes.

At its fourth session held in Geneva from 16 to 27 January 2006,the Working Group held a high-level seminar on complementary international standards which"identified and/or considered" certain specific areas of substantive and procedural gaps, benefiting from the conclusions of the Chair of the high-level seminar.
At the end of its fourth session, the Working Group recommended that with regard to procedural gaps, CERD be requested to conduct a further study on possible measures to strengthen implementation through optional recommendations or the update of its monitoring procedures ibid., para. 108 a.
The Working Group concluded that a successful strategy to combat racism and racial discrimination on a global scale should give relevant attention to the need to reinforce the implementation ofexisting international instruments and to the elaboration of complementary standards to address substantive and procedural gaps in those instruments.
He reported that a seventh topic"Procedural gaps with regard to the International Convention on the Elimination of All Forms of Racial Discrimination" had been added to those discussed at the request of Argentina, speaking on behalf of Armenia, Brazil, Chile, Colombia, Costa Rica, Guatemala, Japan, Mexico, Republic of Korea, Switzerland and Uruguay.
Request OHCHR to send out a questionnaire, within existing resources, to gather information regarding the three topics discussed during the fourth session of the Ad Hoc Committee and in its report(xenophobia,national mechanisms and procedural gaps), including legal and judicial frameworks and practices, substantive and procedural measures in line with the mandate of the Ad Hoc Committee, and possible recommendations.
Furthermore, at its fourth session, the Intergovernmental Working Group identified procedural gaps and stressed the"need for CERD to be able to undertake country visits[as well as the] need to formalize the procedure of follow-up to the recommendations addressed to States parties by CERD in its concluding observations as well as in opinions on individual communications" E/CN.4/2006/18, para. 78.
During the session, the Committee considered the questionnaire and summary of responses received from Member States on three topics: xenophobia; the establishment, designation or maintaining of national mechanisms with competencies to protect against and prevent all forms and manifestations of racism, racial discrimination, xenophobia andrelated intolerance; and procedural gaps with regard to the International Convention on the Elimination of All Forms of Racial Discrimination.
At its fourth session(Geneva, 16-20 January 2006),the Intergovernmental Working Group"identified and/or considered" specific substantive and procedural gaps and recommended that, with regard to procedural gaps, the Committee on the Elimination of Racial Discrimination be requested to conduct a further study on possible measures to strengthen implementation through additional recommendations or to update its monitoring procedures.
During the session, and further to paragraph 4 of Human Rights Council resolution 21/30, the Committee considered the questionnaire and summary of the responses received from Member States on the three topics of xenophobia; the establishment, designation or maintenance of national mechanisms competent to protect against and prevent all forms and manifestations of racism, racial discrimination, xenophobia andrelated intolerance; and procedural gaps with regard to the International Convention.
Welcomes the identification and/or the consideration by the Intergovernmental Working Group on the Effective Implementation of the Durban Declaration andProgramme of Action, during its fourth session, of substantive and procedural gaps in the international instruments to combat racism, racial discrimination, xenophobia and related intolerance and, to this end, requests the Intergovernmental Working Group to continue its work and draft a base document for the Human Rights Council to prepare complementary international standards;
The Working Group established to make recommendations with a view to the effective implementation of the Durban Declaration and Programme of Action( the Working Group) concluded at its fourth session that a successful strategy to combat racism and racial discrimination on a global scale, should direct relevant attention to the need to reinforce the implementation of existing international instruments andthe elaboration of complementary international standards to address substantive and procedural gaps in those instruments.
